These Terms govern access to and use of the Services by individual users, including Project Owners, Team participants, and Reviewers who have been granted access to another user’s Project.
Please read these Terms of Use ("Terms") carefully before using Bleanx’s websites and Services. Bleanx provides a web-based cloud software-as-a-service application at bleanx.ai. Bleanx’s public landing pages and informational materials are provided at bleanx.com. The bleanx.org domain is used for company email addresses and is not the application or landing website. For purposes of these Terms, "Bleanx," "we," "us," and "our" refer to the provider of the Services, and "you" and "your" refer to the individual using the Services. "Services" means Bleanx’s web application, any Bleanx applications actually made available through Apple's app stores, and related online services made available by Bleanx. The application-specific terms and the limits on statements about platform availability are set out in Section 18. Third-party services used in connection with Bleanx are not part of the Services.
Your access to and use of the Services is subject to your acceptance of and compliance with the Terms applicable to you, including the notice, acceptance, transitional-access, and non-acceptance rules in Section 22 and mandatory user rights. These Terms apply to visitors and registered users of the Services, including Project Owners, Team participants, and Reviewers who have been granted access to another user’s Project. Bleanx’s Privacy Policy also applies to the processing of personal data in connection with the Services.
Data Processing Addendum: Data Processing Addendum 2.0
Where Bleanx processes personal data as a processor or subprocessor on documented instructions, the Data Processing Addendum (DPA), Version 2.0, forms an annex to these Terms. The Terms, Privacy Policy and DPA are made available together with the same initial effective date. It is made available with these Terms before acceptance and is accepted through the same act, without a separate signature, additional checkbox, or corporate tariff. Its parties and scope are determined under the DPA, including where a user validly acts for an identified controller or processor. The DPA does not change the individual account or Project Owner, grant additional access, or replace separate permissions for external AI processing, search, or other consent required by law. Its introduction and later changes remain subject to Section 22 and mandatory safeguards.
By validly accepting these Terms, you agree to be bound by the version applicable to you. Changes for existing users, required express acceptance, and the consequences of non-acceptance are governed by Section 22, subject to the special safeguards in Sections 6, 18, and 20 and mandatory law. Merely accessing or continuing to use the Services, signing in, obtaining or exporting data, or deleting an account does not constitute acceptance of a revised version where express acceptance is required. Non-acceptance does not remove the transitional access or mandatory rights preserved by those provisions.
1. Content
For purposes of these Terms: "Bleanx Content" means the software, user interface, platform structure, Contours, Modules, Sections, instructions, system prompts, visual elements, and other information or materials made available by Bleanx or its licensors through the Services. User Content and Output are not automatically treated as Bleanx Content solely because they are processed, stored, or generated through the Services;
"User Content" means any data, materials, or messages that you input, provide, upload, save, or otherwise make available through the Services, including project content, content in sections and forms, user-provided inputs, messages, and images. Bleanx Content is not User Content. AI-generated Output is not included in this definition unless expressly provided otherwise in these Terms;
"Output" means content generated through the Services by AI-powered features, including text, structured results, analyses, responses, suggestions, and summaries generated from user-provided inputs and/or other context used by the Services for the relevant AI action;
"Project" means a structured environment in Bleanx in which a user organizes and stores business information. Project content is organized into Contours, which group Modules and their Sections;
"Contour" means a thematic area of a Project that groups Modules relating to a particular area of the business;
"Module" means a thematic component of a Contour that groups related Sections addressing a particular business topic;
"Section" means an individual content unit within a Module intended for a specific topic, question, or task;
"Reviewer" means an authenticated user accepted by the Project Owner for personal read-only access to Project content within the Contours individually authorized for that user;
Collectively, Bleanx Content and User Content are referred to as "Content."
Content Ownership: As between Bleanx, the Project Owner, and users participating in a Project, all content created or contributed as content of that Project, including User Content and Output, belongs to the Project Owner, subject to the rights and limitations stated below.
Each contributing user hereby assigns to the Project Owner all transferable intellectual property rights that the user holds or subsequently acquires in each contribution to that Project. The assignment takes effect when the contribution is created or contributed as Project content or, for rights acquired later, as soon as they arise or are acquired, to the extent permitted by applicable law. Bleanx hereby assigns to the Project Owner all transferable intellectual property rights that Bleanx holds or acquires in Output generated for that Project or intentionally incorporated into its content, including any such rights received from AI providers. Bleanx's assignment takes effect upon such generation or incorporation or, for rights acquired later, as soon as Bleanx acquires them, to the extent permitted by applicable law.
Where applicable law does not permit assignment of the relevant economic rights, the contributing user or Bleanx, as applicable, grants to the Project Owner the corresponding exclusive rights of use, to the extent permitted by that law. These assignments and grants cover use, reproduction, modification, adaptation, translation, publication, distribution, display, and commercial exploitation of the relevant contribution or Output worldwide for the duration of the relevant rights, including authorization of others to carry out those uses, subject to applicable law.
To the extent permitted by applicable law, each contributing user waives, or agrees not to assert against the Project Owner and its successors, any moral rights in that contribution.
Participation in a Project, creation or editing of its content, initiation of an AI action, payment for that action, or receipt of an exported copy does not give another user independent ownership of the Project materials. Leaving a Project or losing access to the Services does not, by itself, reverse a transfer or grant of rights made under this provision.
Personal Ask content, personal AI Dialogue content, direct messages, profile information, and account billing data are outside this allocation and do not become Project content merely because the Services are used in connection with a Project. If a user intentionally contributes material from a personal interaction as Project content, this provision applies to the contributed material without making the remaining personal interaction or history shared Project content. Outside this allocation of Project content, you retain the rights you lawfully hold in your User Content; rights in personal Output are addressed in "Rights in Output" in Section 4.
Nothing in these Terms prevents a Project Owner from separately assigning or licensing rights that they lawfully hold in Project materials to a company, client, or another person under a separate agreement. Such an arrangement does not, by itself, transfer the account, change the Project Owner recorded in the Services, make the recipient a party to these Terms, or grant additional access to the Services. Any continued use of those materials through the Services must remain authorized by the relevant rights holder.
Bleanx and its licensors retain their rights in the Services and Bleanx Content. Rights in third-party materials are not transferred beyond the rights that the contributing person is authorized to transfer. This provision does not create intellectual property rights where none arise under applicable law or override non-transferable or non-waivable rights, mandatory author entitlements, applicable formalities, or personal data protection rights. Bleanx may process Project materials only within the limited permissions granted under these Terms.
Acceptance at Registration and Project Owner Identification: When you register, you accept the contribution-rights rules in "Content Ownership" as part of accepting these Terms, with the required "Team contributions" control highlighting your express acceptance of those rules. Registration does not transfer rights in all your materials. Rights in each contribution pass to the relevant Project Owner when that contribution is created or contributed as Project content, or when the relevant rights later arise or are acquired, within the scope and subject to the limitations and applicable formalities stated above.
Before you join another user's Project, Bleanx displays the Project Owner's name in the joining interface. No separate confirmation of the contribution-rights rules is requested at that stage. Personal Ask content, personal AI Dialogue content, and direct messages remain outside the Project-content allocation unless you intentionally contribute particular material as Project content, as described above. Acceptance of these rules does not replace the separate permissions required for external AI processing or search, or any consent required by applicable data protection law.
Rights in User Content Granted by You: For User Content created or contributed as Project content, the Project Owner grants Bleanx a limited, non-exclusive, royalty-free, worldwide license, to the extent of the rights the Project Owner lawfully holds, to host, store, reproduce, format or otherwise technically transform, process, transmit, and display that User Content solely to the extent necessary to provide, operate, support, protect, and maintain the Services and to carry out actions requested or authorized by the Project Owner, including actions initiated by users within their granted roles, permissions, and feature settings. For User Content outside that allocation, you grant Bleanx the same limited license to the extent of the rights you lawfully hold, for the provision of the relevant Services and actions that you request or authorize. Bleanx may permit its service providers to perform those activities on Bleanx’s behalf and only to the extent necessary for those purposes. The search provider's independent use of search queries is separately addressed under "External Search Queries" in Section 4. For Project-derived queries, the Project Owner authorizes Bleanx, to the extent of the rights the Project Owner lawfully holds, to transmit those queries when an authorized user enables a supported search and to permit the query-specific uses described there. For queries derived from personal content, the relevant user provides that authorization to the extent of the rights that user lawfully holds. This authorization is confined to the transmitted queries and does not permit separate disclosure of the underlying Project materials or replace any required permission for external search or processing of personal data. For an AI action, including a Reviewer’s personal AI request, User Content and Output may be transferred to an external AI provider only when the user initiating the action has an active permission for external AI processing. A search query may be transferred to our external search provider (identified in Service Providers) as part of a supported AI action only when that initiating user has active permissions for both external search and external AI processing. The license granted by this Section does not itself constitute either permission. In a shared Project, User Content may be processed to carry out actions initiated by users who are authorized to perform the relevant action in that Project, including personal AI requests made by Reviewers within their authorized scope. This does not expand their access rights or transfer ownership to them. Your personal permission for external AI processing applies to AI actions that you initiate. Refusing or withdrawing that permission stops the corresponding future transmissions for your actions, but does not, by itself, prohibit AI processing of all content in a shared Project. Materials that you create or contribute as shared Project content may continue to be used as permitted context for AI actions initiated by other authorized users, even while your own AI permission is off. The necessary permissions of the user initiating that action must be active, and the rules of the relevant feature and "Contextual Use of Project Information" apply. This does not include other users' personal Ask content, AI Dialogue content, or direct messages in shared Project context, except for specific material intentionally contributed as Project content. Applicable requirements concerning lawful processing, withdrawal of consent, erasure and restriction of processing of personal data remain unaffected. Privacy and access to personal Ask content, personal AI Dialogue content, and direct Dialogue messages are governed by "Sharing User Content" below. If a Project Owner separately grants a Team participant or Reviewer access to a selected part of a Project, Bleanx may make the relevant User Content available only within the scope of the selected feature, audience, and settings, subject to "Contextual Use of Project Information" below. These licenses do not transfer ownership of User Content to Bleanx. They are subject to "No Training or Product Development Use of App Data" in Section 4, including its specific external-search exception, and do not authorize any other training or product-development use. Processing of personal data remains governed by the Privacy Policy and applicable law.
Processing and Saved Output: For Output generated for or intentionally incorporated into Project content, the Project Owner authorizes Bleanx to process that Output to provide the relevant features of the Services and carry out actions requested or authorized by the Project Owner, including actions initiated by users within their granted roles, permissions, and feature settings. To the extent of the rights the Project Owner lawfully holds, the Project Owner grants Bleanx a limited license in that Output on the same terms, for the same purposes, and subject to the same limitations as those set out in "Rights in User Content Granted by You". For personal Output outside Project content, the relevant user provides the equivalent authorization and limited license to the extent of the rights that user lawfully holds. These authorizations also cover the necessary processing and display of Output before it is saved.
The provisions of these Terms concerning access, sharing, export, removal, and retention of User Content also apply to Output saved through the Services under the rules of the relevant feature, including Project content and personal AI interaction history, taking into account the relevant feature, where the Output is saved, and the user's role and permissions. Saving personal Output does not make it shared Project content. This provision does not create additional access or editing rights or export methods.
Applying those rules does not include Output in the definition of User Content or alter the allocation of rights under "Content Ownership" in this Section 1 and "Rights in Output" in Section 4. The mere generation, receipt, acceptance, or saving of Output does not mean that the user warrants its authorship, originality, or non-infringement of third-party rights. Obligations to verify information and use the Services lawfully, and responsibility for the user's own actions, remain applicable. This provision is subject to "No Training or Product Development Use of App Data" in Section 4 and does not replace any required permissions for external AI processing or search.
Your Responsibility for User Content: You are responsible for User Content that you make available through the Services and must have the rights and authority necessary to provide it and permit its use in accordance with these Terms. If User Content contains personal data, confidential information, or third-party materials, you must, where required by applicable law, have an appropriate lawful basis, permission, or other necessary authority to provide and use that content through the Services. You must not make available User Content that violates applicable law, intellectual property rights, privacy, confidentiality, or other rights of any third party. Your responsibilities under this paragraph do not relieve Bleanx of its own obligations under applicable law, these Terms, or with respect to security, data protection, and, where applicable, content moderation and the handling of illegal content.
Accuracy and Verification of Information and Output: You are responsible for the accuracy and completeness of factual information, figures, assumptions, and other data that you provide through the Services. Unless expressly stated otherwise, Bleanx does not independently verify the accuracy of User Content. To generate Output, Bleanx may use third-party service providers, including providers of AI models and external search services. Analyses, suggestions, summaries, responses, and other conclusions generated with their assistance may be inaccurate, incomplete, outdated, biased, or unsuitable for a particular purpose, even when Output includes links to sources. Bleanx does not guarantee the accuracy, completeness, reliability, or suitability of such Output. You must independently review and verify the underlying data, sources, and conclusions before using them for business, financial, legal, investment, or other material decisions and should seek advice from a qualified professional where appropriate. Nothing in this paragraph excludes or limits Bleanx’s liability for its own acts or omissions, defects in the Services, or any rights or remedies that cannot be excluded or limited under applicable law.
Sharing User Content: User Content made available in a shared Project may be directly accessed by Team participants and Reviewers only in accordance with their respective roles, permissions, and the Project settings. Contextual use of information when preparing Output and summaries is described in "Contextual Use of Project Information". The Project Owner grants, changes, and revokes Team participants' and Reviewers' access to the Project and individually determines which Contours are accessible to each of them. By making User Content available in a shared Project, you understand that the Project Owner may manage access to that content. Personal Ask content and personal AI Dialogue content of any user, including a Reviewer, do not become part of the shared Project and are not made available to the Project Owner, Team participants, or other Reviewers solely because of their role. Direct Dialogue messages, including messages exchanged with a Reviewer, remain available only to the sender and intended recipient and do not become shared Project content. Granting access to Project materials does not transfer ownership to the recipient. Team participants and Reviewers may use those materials only within the permissions granted for the Project in accordance with these Terms. Access or permitted export does not, by itself, authorize their independent commercial exploitation, publication, or licensing without permission from the Project Owner or the relevant rights holder. Rights in contributions to the Project are governed by "Content Ownership" above. You must not make User Content available in a shared Project if you are not authorized to disclose it.
Contextual Use of Project Information: Access to a Contour determines which content in that part of a Project a user may directly open, view, and export, subject to the user's role and the export rules. To keep Output and summaries consistent with the business described in the Project, Bleanx may use relevant business information from the entire Project, including Contours that are not accessible to that user, as background context when preparing Output and summaries within the Contours available to that user.
Such use does not give the user direct access to Contours that are not accessible to them. The Services are not designed to reproduce the content of those Contours to the user as an alternative way of viewing them. However, Output and summaries available to the user, including previously saved results, may reflect the overall business context and may include information derived from those Contours. Accordingly, restricting access to a Contour does not, by itself, prevent information from that Contour from being reflected in results available to the user.
The Project Owner should take this into account when granting access to Team participants and Reviewers. This provision does not override applicable personal data protection requirements or any required permissions for transferring personal data to external AI providers. The personal AI setting of the author of Project material, including the Project Owner, does not, by itself, exclude that material from the context of permitted AI actions initiated by other authorized users. The limits of personal permission and the preserved personal data rights are described in "Rights in User Content Granted by You".
Reviewer Access and Personal Features: A Reviewer may not modify or generate shared Section content, manage the Team, or read the shared Project Journal. A Reviewer may use Ask for personal AI requests and responses, use personal AI Dialogue, and exchange direct one-to-one messages with other Project participants through Dialogue, subject to the applicable permissions and rules of the Services. These capabilities do not expand the Reviewer’s access to Project content or grant editing rights. The privacy rules in "Sharing User Content" and the AI and search permissions in "Rights in User Content Granted by You" apply. Export rights are set out in "Export of Project Materials"; reporting and blocking rights are set out in "Content Rules, Reporting, and Moderation" and "Blocking and Contact".
"Discover Content" means articles and other informational materials published by Bleanx in the Discover section of bleanx.com about Bleanx features, workflows, technology, and product development. Discover Content is provided for informational purposes only. It does not amend these Terms, create a separate warranty or commitment, or mean that any described future feature is already available. If Discover Content conflicts with these Terms, these Terms control. This provision does not limit mandatory rights of users, including rights relating to Bleanx's public statements about the Services, where provided by applicable law.
Removal and Retention of User Content: You may delete or clear User Content using the controls made available for the relevant feature of the Services, subject to your role and permissions, and may exercise applicable rights to deletion of personal data as described in the Privacy Policy. The effect of deletion depends on the type of content and where it is used. Clearing a Section value removes the saved value for that Section but does not by itself delete source data, connected Sections, summaries, or other separately stored content. A Team participant or Reviewer may leave a Project owned by another user. Only the Project Owner may remove a Team participant or Reviewer from a Project or revoke that user’s access. Leaving a Project, removal from a Project, or revocation of access ends that user’s future access but does not by itself delete their account, their own Projects, or User Content previously contributed to the shared Project. When a user leaves a Project, is removed from it, or otherwise loses access to that Project, their personal AI Dialogue history associated with that Project is deleted. A later invitation or renewed access does not restore the deleted history. These Project-related events do not automatically delete the user's entire Ask history or direct correspondence, which remain subject to their separate deletion rules. Only the Project Owner may delete a Project that they own. Upon the Project Owner's final confirmation, that Project, its content including saved Output, associated files, summaries, and Journal are immediately and irreversibly deleted from the operational systems of the Services. The Project Owner, all Team participants, and all Reviewers lose access to the deleted Project. Personal AI Dialogue histories associated with that Project are also deleted for all affected users. There is no recovery period, and restoration of the deleted Project or those histories is not provided. Deleting a Project does not delete participants' accounts or other Projects they own or can access or, by itself, cancel a Subscription. Bleanx may retain limited copies of User Content to the extent and for the period necessary to comply with law, maintain required financial or technical records, protect the Services, prevent abuse, resolve disputes or legal claims, and complete scheduled deletion from backups. Retained data will not be used for new unrelated purposes. Limited lawful retention of particular records and handling of residual backup copies do not postpone immediate operational deletion or create a recovery period for a deleted Project. Account deletion by a user is governed by "Account Deletion by You" in Section 12, which describes the effects on Projects the user owns, access to other users' Projects, retained Project contributions and correspondence, personal Ask and AI Dialogue content, Subscriptions, and refunds. Processing of retained personal data, backup copies, and data held by external providers is also governed by the Privacy Policy and applicable law.
Limited License to Bleanx Content: Subject to your compliance with these Terms and while you have authorized access to the Services, Bleanx grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, and use Bleanx Content through the Services for lawful personal, business, professional, and consulting purposes, including developing your own Projects, collaborating with authorized Team participants, reviewing Project materials as a Reviewer, and preparing materials for clients, partners, advisers, investors, lenders, or other intended recipients. This license does not transfer ownership of Bleanx Content. Except as expressly permitted by the Services, by Bleanx, or by applicable law, you may not extract or use the software, platform structure, system instructions, Modules, Sections, or other Bleanx Content independently of your authorized Project materials to reproduce, distribute, sell, license, or create a standalone or competing product. Rights in User Content and Output are governed separately by these Terms.
Export of Project Materials: A Project Owner, Team participant, or Reviewer with authorized access to a Module may export the saved values of Sections in that Module from the Canvas in Markdown, PDF, or JSON format. Read-only Reviewer access does not prevent export of an individual Module within the Reviewer’s authorized scope. The Project Owner may separately download a full export of their Project through Settings > Project in Markdown, PDF, or JSON format. That export includes saved Section values, the Project structure needed to organize and understand them, and applicable AI-origin indicators in accordance with Section 4. Team participants and Reviewers may not use the full-Project export feature for a Project they do not own. JSON preserves the structured representation of forms and tables, while Markdown and PDF present the exported information in a readable form. Each export is limited to content within the user’s authorized scope, and exporting content does not grant additional access or editing rights. Export does not transfer ownership of User Content or Output or grant independent rights to exploit those materials; their use remains subject to "Content Ownership" and "Sharing User Content" in this Section 1. Exported materials may contain User Content, Output, and limited elements of Bleanx Content necessary to organize and understand the exported materials. Export does not transfer ownership of Bleanx Content or authorize separate extraction or distribution of Bleanx’s platform structure, system instructions, or other proprietary materials.
Account Data, Access and Portability: In Settings > Account, selecting "Export all user data" immediately generates a complete package containing your account data and all Projects you own. The package includes your profile, saved personal Ask and AI Dialogue histories, account settings, purchase history, the content and structure of your own Projects, associated metadata, and applicable AI-origin indicators. It also includes other personal data, exportable data, and digital assets within the applicable scope of Articles 15 and 20 GDPR and Chapter VI of the EU Data Act, subject to the lawful safeguards below. The examples listed here do not limit the applicable statutory scope. Displaying remaining resource allowances as percentages does not restrict your applicable rights under this Section to obtain usage and purchase data relating to you.
Structured data is provided in JSON, with the files needed to make the package usable and understandable. Bleanx provides the information about processing required for an applicable Article 15 access request together with the corresponding copy of personal data. The export format and programmatic access are described in publicly available documentation on bleanx.com, as further set out in Section 12. Providing the data in one package does not make all exported material personal data or data provided by you for the purposes of Article 20, or change the allocation of rights in User Content, Output, or Bleanx Content.
Programmatic Export: The same complete export is available through a documented, protected, read-only programmatic interface, using an export access key that you create and may revoke. You may use the key yourself or authorize a destination provider to retrieve the export on your behalf. The interface is available free of charge and on an equal basis to you and the relevant authorized destination provider. Access is limited to the data you are entitled to obtain; it does not give the recipient additional rights to other users' Projects or private content.
Scope and Safeguards: The package does not include another user's entire Project solely because you participate in it, or other users' private AI histories, account settings, or purchases. Existing permissions to export individual Modules remain governed by "Export of Project Materials" above. These limits do not exclude your personal data from an applicable access request merely because it is contained in a shared Project, correspondence, or a security log. Bleanx applies necessary, proportionate safeguards for other persons' rights, confidentiality, and security, including targeted redaction or extracts where appropriate, rather than a blanket exclusion of all shared materials or technical records.
Export does not require disclosure of Bleanx's source code, system instructions, system prompts, access credentials, or other protected internal material outside the applicable statutory scope. Necessary identifiers, relationships, and elements of structure are retained so that the exported data can be understood and used. These safeguards do not narrow mandatory access or portability rights, prevent lawful export, or transfer ownership of Bleanx Content.
Support and Statutory Rights: You may alternatively contact support@bleanx.org to obtain your data, exercise applicable access or portability rights, or resolve an incomplete or unsuccessful export. You are not required first to use the download function or repeat a valid request. Bleanx fulfils these rights, including the copy and processing information, direct transmission where required and technically feasible, proportionate identity verification, and lawful limits on charges, under Section 6 of the Privacy Policy. Those procedures do not reduce the complete export or access safeguards promised in this Section.
Response Periods: Bleanx handles personal data requests within the applicable periods and safeguards set out in Section 6 of the Privacy Policy, including the GDPR one-calendar-month response period, permitted extensions, reasoned refusals and remedies. An acknowledgement alone is not fulfilment. These periods do not delay immediate self-service export or replace the separate EU Data Act switching process in Section 12.
Content Rules, Reporting, and Moderation: Your use of the Services and User Content must comply with these Terms and applicable law. Project content is accessible to users only within the scope of their granted permissions. Team participants and Reviewers may report to Bleanx specific content that is accessible to them and that they believe violates applicable law or these Terms. The right to submit a report does not depend on editing rights: a Reviewer may report content while retaining read-only access. Bleanx uses proportionate filtering measures intended to prevent objectionable User Content from being posted or transmitted to other users, and reviews identified violations and reports received. These measures do not mean that every document, Section change, or message requires prior manual approval and do not guarantee detection of all violations. Submitting a report does not by itself remove content or change access rights. Bleanx reviews reports in a timely, good-faith, and objective manner, taking the circumstances into account. Following review, Bleanx may take no action or may proportionately restrict access to specific content, direct messages, a Project, or an account in accordance with these Terms and applicable law. In a direct human Dialogue, you may also report a specific message or the other participant’s conduct. Personal Ask content and personal AI Dialogue content accessible only to the relevant user are not subject to the mechanism for reporting another user’s content.
Blocking and Contact: In a direct human Dialogue, any participant, including a Reviewer, may block the other participant to prevent that user from sending them new direct messages. Blocking applies only to direct messaging and does not by itself remove the blocked user from a shared Project, change that user’s Project permissions, or delete messages already sent. Project participation and access are managed separately by the Project Owner. You may report content, messages, or another user’s conduct through the reporting tools made available in the Services or by contacting Bleanx at support@bleanx.org. After reviewing a report, Bleanx may separately restrict content, direct messaging, access to a Project, or an account as described above.
Acknowledgement of Reports: After receiving a report through the reporting tools in the Services, Bleanx sends the reporting person a private system notification in Dialogue without undue delay. The notification is clearly identified as a Bleanx system message, not an AI response or a message from another participant. Among users of the Services, it is accessible only to the reporting person. It is not posted to a shared Project or Journal and is not made available to other users, including the Project Owner, Team participants, or Reviewers, solely because of their role.
The acknowledgement confirms receipt of the report only. It does not constitute a finding that a violation has occurred, a decision on the merits of the report, or the imposition of any restriction.
If a report is submitted through support@bleanx.org or another available reporting channel outside Dialogue, or if the reporting person cannot access Dialogue, Bleanx sends an acknowledgement without undue delay through an available electronic contact channel provided by that person.
Report Outcomes: After reviewing a report, Bleanx notifies the reporting person by email without undue delay of the outcome, with relevant details and the information required by applicable law.
Notice of Restrictions: When Bleanx imposes restrictions in connection with a violation of applicable law or these Terms, Bleanx notifies the affected user by email, explaining the measure, its reasons, and available ways to challenge the decision, in accordance with the time limits, requirements, and exceptions under applicable law.
Review of Moderation Decisions: A reporting person or a user affected by a Bleanx moderation decision may request a review free of charge by contacting support@bleanx.org and identifying the decision and the reasons for disagreement.
Bleanx reviews such requests in a timely, good-faith, objective, and non-discriminatory manner. Review decisions are taken under the supervision of an authorized and appropriately qualified member of staff and are not based solely on automated means. Bleanx notifies the person requesting review by email of the outcome and the reasons for it, and reverses or amends an erroneous decision without undue delay. Other remedies available under applicable law remain unaffected.
Investigations and Cooperation with Authorities: Bleanx may investigate suspected violations of these Terms or applicable law, fraud, abuse, and security incidents relating to the Services. Access to user data for these purposes is limited to authorized persons, to the extent necessary, and in accordance with the Privacy Policy and applicable law.
Bleanx verifies the authority of the requesting body and the legal basis for its request. Data is disclosed to competent authorities only where required or permitted by applicable law, to the extent necessary and proportionate, and in compliance with data protection and cross-border transfer requirements.
Where required by applicable law, Bleanx promptly reports to competent authorities circumstances giving rise to a suspicion of a criminal offense, including an offense involving a threat to the life or safety of persons, and provides relevant information available to Bleanx to the extent required by law.
Bleanx notifies the affected user of a request and disclosure of data where and in the manner required by applicable law, subject to the restrictions and exceptions provided by that law.
2. Restrictions on Your Use of the Services
Prohibited Content: You must not upload, save, transmit, or distribute any of the following materials through the Services, or use the AI-powered features of the Services to create them:
(a) Unlawful materials and infringement of others' rights: content that violates applicable law, intellectual property rights, privacy, or confidentiality obligations, including unlawful disclosure of personal data or trade secrets.
(b) Fraud and deception: materials used for fraud or to intentionally mislead others, including forged documents, fabricated facts presented as true, and unauthorized impersonation or misrepresentation of authority. This prohibition applies, in particular, when preparing Project materials, including User Content and Output, using the Services or presenting such materials to investors or lenders in connection with raising investment or obtaining loans.
(c) Threats, harassment, and harm: threats, stalking, targeted humiliation, defamation, incitement to hatred or discrimination, calls for violence, suicide, or self-harm, and graphic depictions of cruel violence against people or animals.
(d) Pornography and sexual exploitation: pornographic materials, materials depicting sexual violence or exploitation, sexualized materials involving minors, and intimate images are prohibited. Consent from any depicted person, author, sender, recipient, or other person does not create an exception to this prohibition.
(e) Facilitation of criminal activity: materials intended to organize, encourage, or facilitate crimes, including terrorism, human trafficking, and illegal trade in goods or services.
Good-faith business forecasts, assumptions, scenarios, assessments, and business criticism are not prohibited in themselves, provided they are not presented as established facts and do not violate the above rules. The obligations to verify information and Output under Section 1 remain applicable.
The mere presence of personal data or confidential information does not make material prohibited. Such data or information may be provided and used only with the necessary rights and lawful bases and in compliance with data protection requirements.
No permission from Bleanx overrides applicable law. Investigations of violations, restrictions, and reviews of decisions are governed by Section 1.
Software Protection: You must not copy the software comprising the Services beyond authorized use, decompile, disassemble, reverse engineer it, or otherwise attempt to extract its source code, except as expressly permitted by Bleanx or allowed by applicable provisions of law that cannot be excluded by contract.
This prohibition does not restrict ordinary authorized use of the Services, work with User Content and Output, or export of Project materials in accordance with Section 1.
Service Security and Prohibited Interference: You must not:
(a) Disrupt the Services: use the Services to carry out attacks, intentionally interfere with their operation or other users' access, damage systems or data, or create malicious load, including through mass automated requests.
(b) Obtain unauthorized access: access or attempt to access accounts, Projects, data, computer systems, or networks beyond your granted permissions, including through misuse of another person's credentials or exploitation of vulnerabilities.
(c) Circumvent safeguards: without proper authorization, bypass, disable, alter, or interfere with security, authentication, or access-control measures.
(d) Introduce malicious tools: introduce or distribute through the Services viruses, malicious code, or other tools intended to disrupt operations, damage data, obtain unauthorized access, or steal information.
Ordinary good-faith use of available features within your granted permissions and applicable terms, including generation, collaboration, and export, does not in itself violate this provision solely because of the load it creates.
Activities separately authorized by Bleanx are permitted only within the scope of that authorization and applicable law. This provision does not restrict rights that cannot be excluded by contract and does not relieve Bleanx of its own obligations concerning security and data protection.
Usage Limits and Resource Availability: Your plan determines the number of Projects you may own, available features, and two separate included allowances: one for AI use across all available models and one for web search. A Project Owner must have active paid-plan access to invite new Team participants. Reviewer requests may be accepted on all plans, including Explorer. Moving to Explorer does not, by itself, delete existing Projects, including Projects above the Explorer limit, or end the access of previously admitted Team participants and Reviewers. Those users continue within their existing roles and permissions using their own available allowances and separately purchased Usage Credits. New Project creation and new Team invitations remain subject to the applicable plan rules in Section 5. Monthly Usage Allowances, one-time Explorer Welcome Allowances, and separately purchased Usage Credits are described there. Before you select a plan or make a purchase, Bleanx clearly discloses the material features and restrictions, including these invitation and participation rules, the Founder and Executive allowances relative to the corresponding Explorer baselines, the factors affecting consumption, the monthly Subscription periods and the one-year duration of the one-time Welcome Allowances, and the consequences of exhausting an allowance. This information remains accessible within the Services.
Included allowances are not offered or displayed as quantities of credits or other absolute resource units on pricing pages, at checkout, or in the interface. Instead, the interface continuously displays separate percentages remaining for AI and web search, with the applicable period or expiry information. Each percentage shows the unused share of its allowance, not a monetary balance or a guaranteed number of completed tasks. Usage Credits purchased separately are displayed as a separate credit balance. This presentation does not reduce Bleanx's duty to provide the information required by applicable law.
You must comply with applicable limits and must not circumvent the measures used to enforce them. Reaching a limit or exhausting a resource does not, by itself, constitute abuse or a breach of these Terms.
When the relevant AI or web-search allowance is exhausted, the corresponding consumption uses available separately purchased Usage Credits under the disclosed rules in Sections 4 and 5. The two allowances are not interchangeable. If the resources required for a new action are unavailable, Bleanx restricts that action under the disclosed rules and informs you of the reason and available ways to continue. Exhausting an allowance or purchased credit balance does not, by itself, delete saved Projects or end access to viewing, manual work, or permitted export within your granted permissions.
This provision does not authorize Bleanx to reduce the scope of Services already paid for or introduce undisclosed restrictions. The protection of allowance amounts and consumption rules, advance notice, and separate express acceptance of adverse changes are governed by Section 6 and applicable law.
Automated Access and Data Extraction: You must not use bots, scripts, scrapers, or other automated tools for bulk or systematic extraction, copying, or collection of data from the Services, except for activities expressly supported by the features of the Services, separately authorized by Bleanx, or permitted by applicable provisions of law that cannot be excluded by contract.
Automated or organized manual collection must not be used to circumvent granted access permissions, security measures, or applicable limits, or to obtain other persons' data unlawfully.
This prohibition does not restrict ordinary copying of materials you are entitled to use, authorized export of Project materials in accordance with Section 1, or ordinary use of the interface with assistive technologies. Applicable statutory rights of access to data, data portability, and switching service providers remain unaffected.
Obtaining a copy or exporting content does not expand your rights in that content or authorize independent extraction or use of Bleanx Content beyond the license granted under these Terms.
Lawful Use and Compliance: When using the Services, you must comply with applicable law and these Terms and must not violate the rights of others.
Specific prohibitions on content, conduct, and technical activities are set out in this Section 2. Investigations of suspected violations, the imposition of restrictions, and reviews of decisions are governed by Section 1.
Sanctions and Export Controls: The provision and use of the Services must comply with applicable sanctions, export control, and trade restriction laws and regulations, including those of the United States and, where applicable, the European Union and other relevant jurisdictions.
You must not use the Services or provide others with access to them where such provision or use is prohibited by applicable restrictions relating to the recipient, territory, or intended use. Where a license or other authorization from a competent authority is required, the relevant provision or use is permitted only where the required authorization is in place or an applicable lawful exception applies, and all relevant conditions are met.
You must not circumvent these restrictions, including by concealing or misrepresenting material information about the recipient, their location, or the intended use for the purpose of such circumvention. Permission from Bleanx does not, by itself, replace any required government authorization or override applicable law.
Bleanx applies the restrictions necessary to comply with these requirements. Your obligations under this provision do not relieve Bleanx of its own obligations to verify whether the Services may lawfully be provided and to comply with applicable law.
Misleading Use of Output: You must not use Output to mislead others about its origin, reliability, verification, or endorsement. In particular, you must not present unsubstantiated forecasts or assessments as established facts, or claim that Output has been professionally verified or endorsed by Bleanx, a specialist, or any other person where that is not true.
The involvement of AI does not, by itself, prevent lawful editing, verification, or use of Output. Any description of verification performed must accurately reflect its actual scope. When using or distributing Output, you must comply with applicable legal requirements concerning disclosure of its AI origin and labeling.
The obligations to verify information and Output set out in Section 1 remain applicable. This provision does not alter rights in Output or relieve Bleanx of its own obligations regarding AI transparency.
3. Accounts
Account Access and Security: To use features of the Services that require authentication, each user, including a Project Owner, Team participant, or Reviewer, must use their own account and an available sign-in method. Collaboration and access to another person's Project take place through the relevant access permissions under Section 1, not by using another person's account.
You must take reasonable steps to protect your account, the means you use to sign in, and the devices from which you access the Services, and keep your secret sign-in credentials confidential. You must not share such credentials with others or allow them to use the Services under your account. These obligations also apply to any account with a third-party provider that you use to sign in to Bleanx.
You are responsible for your own actions in the Services and, to the extent provided by applicable law, for the consequences of your breach of the account security obligations under these Terms. The mere fact that an action occurs through your account does not make you unconditionally responsible for unauthorized access or actions of third parties.
If you discover unauthorized use of your account, loss of control over it, or have reasonable grounds to suspect a security compromise, you must notify Bleanx without undue delay at support@bleanx.org.
Bleanx implements technical and organizational measures appropriate to the risks to protect accounts and data, reviews reports of security incidents, and takes necessary and proportionate response measures. Such measures may include temporarily restricting access to the affected account where reasonably necessary to protect the user, other users, or the Services. Bleanx informs the user of such a restriction and how to regain access through an available contact channel, unless doing so would undermine the security of the account. A protective restriction of this kind is not, by itself, a finding that the user has violated these Terms. Your obligations under this provision do not relieve Bleanx of its own security and data protection obligations or limit any user rights that cannot be excluded by contract.
Profile Name and Image: Your profile name and image in the Services must comply with the Prohibited Content rules in Section 2, including the provisions concerning the rights of others and the prohibitions on unauthorized impersonation or misrepresentation of authority. These rules apply regardless of your role in a Project.
The handling of reports, imposition of restrictions, notifications, and review of decisions concerning a profile name or image are governed by Section 1.
Age and Eligibility: To create an account and use features of the Services that require authentication, you must be at least 18 years old and have the legal capacity required under applicable law to enter independently into a contract with Bleanx. This requirement applies to all users, including Project Owners, Team participants, and Reviewers, regardless of whether they have a paid subscription.
By creating an account or using it, you confirm that you meet these requirements. The consent or involvement of a parent, guardian, employer, or Project Owner does not create an exception to the minimum age established by this provision.
Bleanx applies proportionate measures to enforce the age requirement. Where there are reasonable grounds to doubt whether you meet the age requirement, Bleanx may request necessary verification and temporarily restrict access to your account while verification is pending. Where failure to meet the age requirement is confirmed, Bleanx does not provide or discontinues access to features that require authentication. Verification is conducted with personal data limited to what is necessary and in accordance with the Privacy Policy and applicable law. Notice of a restriction and an opportunity to challenge an erroneous decision are provided in accordance with Section 1. Such a restriction does not override mandatory user rights.
4. AI-Powered Features
The Services include AI-powered features that help create, supplement, and analyze Section content in Projects, prepare summaries, and respond to user requests. In supported scenarios, searches of external sources may be used in preparing results when enabled by the user and subject to the necessary permissions and available resources. The term Output has the meaning given in Section 1.
The content of Output depends on the available model selected by the user or applied by default, user-provided inputs and/or other context used for the relevant feature. AI actions and external search require the applicable access rights, permissions, and resources: the corresponding Monthly Usage Allowance or Welcome Allowance, or available separately purchased Usage Credits. All available AI models use the same AI allowance for the user. Web search has a separate allowance. Contextual use of Project information is governed by "Contextual Use of Project Information" in Section 1.
Resource Accounting: Consumption is attributed to the user initiating the action, including its prescribed related updates. It does not become a shared Team resource or the Project Owner's expense merely because the action concerns a shared Project. The initiating user and selected model remain associated with the initiated action and its prescribed chain. Consumption depends on the selected model and the overall request context; an equal number of actions does not necessarily consume an equal percentage.
Search itself uses the web-search allowance; AI processing, including processing search results, uses the AI allowance. Once the corresponding allowance is exhausted, that component uses available purchased Usage Credits even if the other allowance remains available. The same component of consumption is not charged both to an allowance and to purchased credits. A supported action involving both search and AI may therefore consume both types of resource without charging the same work twice. No automatic purchase, additional payment authorization, or debt for uncovered consumption is created by these rules.
Saving AI-Generated Results: Output is saved according to the rules of the relevant feature. In ordinary text and structured Sections, AI generates a proposal that becomes the saved value when accepted by the user. A rejected proposal does not replace the existing saved value. When the user selects "accept and edit", the result is first accepted and saved; cancelling a subsequent manual edit does not, by itself, undo that acceptance.
Managed Overview / Summary and Key Research Questions results are saved automatically as part of the relevant AI action and its prescribed related updates, without separate acceptance of each result. Displaying text during generation does not, by itself, confirm that the result has been finally saved.
The saving method does not alter the allocation of rights under "Content Ownership": Output generated as Project content, including automatically saved results, belongs to the Project Owner within the scope of that provision. Accepting or saving a result does not, by itself, establish its accuracy or professional verification.
AI Transparency and Origin Marking: Bleanx clearly and accessibly identifies the use of AI in the Section-generation interface and in the AI modes of Ask and AI Dialogue no later than the user's first corresponding interaction with AI.
Where required by applicable law, Bleanx ensures that Output is marked in a machine-readable format and that its AI origin is detectable, including applicable results provided before saving, personal AI responses, and AI content in exported materials. The technical solutions used ensure effectiveness, interoperability, robustness, and reliability as far as technically feasible, taking into account the characteristics of the content, implementation costs, and the generally acknowledged state of the art.
For a saved value, Bleanx uses a single AI-origin indicator. It indicates that AI generation was used in creating or modifying that value and does not mean that all of its current content was created exclusively by AI. The indicator is recorded when an AI result is saved, including when it is saved automatically, and is retained through subsequent user edits. For a mixed form, the indicator applies to the value when at least one field contains AI-generated content; deterministic recalculation alone does not create the indicator.
When a value is fully cleared, its associated indicator is removed. New manual input does not inherit the indicator of the deleted value merely because the same Section is used. The absence of an indicator does not confirm human origin or the absence of AI in material provided by a user. This process does not override applicable obligations to mark AI content when it is provided again through the Services.
On export, Bleanx carries the applicable machine-readable marking into the exported materials, linked to the relevant content. Marking part of the material does not mean that the entire exported document was created by AI. Subsequent changes outside the Services are not certified by Bleanx.
Notices and markings do not confirm accuracy, professional verification, or editorial responsibility and do not alter the rights in content established in Section 1. Users' obligations to disclose AI origin when using or distributing materials apply where required by law, in accordance with Section 2. Marking provided by Bleanx does not replace such disclosure where it is mandatory.
Rights in Output: Output generated for the content of a Project or intentionally incorporated into that content belongs to the Project Owner in accordance with "Content Ownership" in Section 1. That provision governs Bleanx's assignment of its rights, including rights received from AI providers, and any alternative grant of exclusive rights of use. Team participants and Reviewers receive only the permissions granted for that Project; they do not receive an independent license from Bleanx to exploit its Output.
For personal Output outside the allocation of Project content, to the extent that Bleanx holds intellectual property rights in that Output, Bleanx grants the user to whose personal interaction it relates a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute that lawfully obtained Output, including for commercial purposes, subject to these Terms and the rights of others. This license lasts for the duration of the relevant rights and does not terminate solely because that user's access to the Services ends. Intentionally contributing material from a personal interaction as Project content is governed by "Content Ownership" in Section 1.
Apart from the transfers and permissions expressly provided in "Content Ownership" and this paragraph, Bleanx exercises any rights it may hold in Output only as permitted under "Processing and Saved Output" and does not license Output to third parties for their own independent purposes. The specific exception for external-search queries is governed exclusively by "External Search Queries" below and the corresponding authorization in Section 1; it does not grant independent rights in the underlying Output or Project materials beyond the transmitted query.
The existence and scope of intellectual property rights in Output are determined by applicable law. Bleanx does not promise that every Output is protected by copyright. This does not alter the allocation of Project content under Section 1. Bleanx Content and third-party materials included in Output remain subject to the rights and limitations stated in "Content Ownership" and "Limited License to Bleanx Content" in Section 1.
Output may not be unique: similar or identical results may be generated for other users. This notice does not grant access to other users' content or authorize its disclosure. This provision does not limit mandatory user rights.
No Training or Product Development Use of App Data: Bleanx does not use, and will not use, data processed in connection with Bleanx applications and the related Services—including User Content, Output, Project materials, personal AI interactions, account data, and application usage data—to train, fine-tune, or improve AI models, to research, develop, or improve products or features, or for similar independent purposes. This prohibition also applies to aggregated, de-identified, anonymized, or otherwise transformed information derived from that data. Bleanx does not provide such data to others for those purposes, except for the narrowly scoped provider processing expressly described under "External Search Queries", "Payment Providers' Limited Use of Payment Data", and "Email Providers' Limited Use of Delivery Data" below. None of these exceptions permits Bleanx itself to use application data for any of the prohibited purposes.
Necessary Operational Processing: This prohibition does not prevent necessary and proportionate processing to provide the requested features of the Services; store, display, and export content; perform authorized AI actions and searches; authenticate users; provide support; maintain security; prevent abuse; investigate violations; diagnose and remedy technical failures, including through technical logs; administer billing, Monthly Usage Allowances, Welcome Allowances, and separately purchased Usage Credits; or comply with legal obligations. Such processing is limited to the relevant operational purpose and remains subject to these Terms, the Privacy Policy, applicable access permissions, and applicable law. Operational processing is not permission to reuse the data for model training or independent product development.
Voluntary Bug Reports: When a user voluntarily sends Bleanx a bug report, Bleanx uses the report and any materials supplied with it only as necessary to diagnose, reproduce, correct, and verify the correction of the reported error. Those materials are not used for model training, general research datasets, or development of new features. Submitting a report does not transfer ownership of its contents or attachments to Bleanx or expand the sender's rights in another person's materials. Bleanx does not forward user data through provider feedback channels that permit its use for model training or product development. Where provider assistance is necessary, Bleanx uses a support channel consistent with these restrictions or reproduces the issue without user data.
AI Model Providers: Bleanx engages the providers of the AI models used to generate Output under contractual terms and settings that exclude the use of application data supplied to them for model training or independent product development. Bleanx does not enable optional data-sharing or feedback programs that would permit such use. Processing necessary to deliver the contracted AI service, maintain security, prevent abuse, or comply with law remains subject to the applicable agreements and legal requirements. A restriction on training does not, by itself, mean that the provider retains no data.
External Search Queries: External search is optional and operates only in supported scenarios when enabled by the initiating user with the permissions required under Section 1. The content transmitted for search differs between the following scenarios.
Section generation: Search is limited to Sections designated as suitable for external search. Bleanx prepares a purpose-limited search query from limited general business context, rather than sending the Project as a whole or its full AI context. These system-prepared queries are designed to avoid personal, confidential, and sensitive information. This preparation does not constitute an absolute guarantee that no such information can ever appear in a query.
Ask with web search: When Ask is used with web search enabled, Bleanx may clean up and shorten your question when preparing a search query. The query transmitted to the search provider may therefore differ from your original question. In some cases, external search is not performed; enabling search does not mean that a search will be run for every question. This preparation does not guarantee anonymization or the absence of personal, confidential, or sensitive information from the transmitted query. Do not include personal or confidential information, including personal data about other people, in questions for web search.
When external search is performed in either scenario, Bleanx transmits the corresponding search query to our external search provider (identified in Service Providers). The provider's applicable terms permit it and relevant providers involved in its search services to retain and use the transmitted queries for their own research, service improvement, and model-training purposes. This exception is confined to the transmitted search queries; it does not permit Bleanx to separately supply underlying Project materials or full AI context for those purposes, and does not change the no-training requirements applicable to the AI model providers described above. Neither the exception nor the manner in which a query is prepared reduces Bleanx's obligations concerning data minimization, lawful disclosure, and security.
Before external search is enabled, Bleanx discloses the recipient, the information transmitted in each of these scenarios, and the provider's independent uses. The initiating user may disable external search to stop future query transmissions for actions they initiate. Disabling search does not, by itself, delete queries already received by the provider; applicable data protection rights remain unaffected. Permission to use external search does not authorize unlawful disclosure of another person's personal data or confidential information and does not replace any lawful basis, permission, or safeguard required by applicable law.
Payment Providers' Limited Use of Payment Data: Stripe and Apple, in their payment-provider capacity, process payment data concerning the purchaser, payment method, and transaction under their applicable terms and privacy notices, including for fraud prevention and improvement of their payment services, subject to applicable law. This is a limited exception to the restrictions on independent provider use above, applying only to that payment data and those providers' payment-related processing. It is not a general exception for all data held by or accessible to either provider.
The exception does not extend to Project materials, User Content, Output, personal Ask or AI Dialogue content, direct messages, or Bleanx's allowance and consumption records, including transformed information derived from those materials or records. Purchase records, including the product bought and amount paid, are distinct from records of how AI, search, allowances, or purchased credits are used within Bleanx. Providing necessary purchaser information for a payment does not open the rest of the user's account or content to the payment provider.
This exception does not authorize Bleanx to disclose those excluded materials or records for payment-service improvement or to use application data itself for model training or independent product development. It does not change ownership, extend the licenses in User Content or Output, alter the restrictions on AI model providers or bug reports, or replace required consent, lawful bases, international-transfer safeguards, or Bleanx's own data protection obligations. Payment-data processing and its limits are further described in the Privacy Policy.
Email Providers' Limited Use of Delivery Data: Resend and the infrastructure providers involved in its email-delivery chain, including Amazon Web Services / Amazon SES, may process service delivery data under their applicable terms and privacy notices, including for operating and optimizing their email-delivery services, subject to applicable law. This exception is confined to sender and recipient addresses, delivery statuses, bounces and delivery failures, and technical transmission metadata. It is not a general exception for all information a provider calls usage data or service data.
This exception does not authorize reuse of email subjects, bodies, attachments, or information extracted from that content beyond processing necessary for delivery. It does not extend to Project materials, User Content, Output, personal Ask or AI Dialogue content, direct messages, or Bleanx's allowance and consumption records, including transformed information derived from those materials or records. The listed sender and recipient addresses are delivery metadata, not permission to inspect or reuse the underlying correspondence for independent optimization, model training, or product development. This exception does not extend to Google Workspace in its separate support-mail role or to Google in its AI or sign-in roles.
The exception does not authorize Bleanx itself to train models or independently research, develop, or improve products or features using application data. It does not authorize marketing, tracking recipients' email opens or clicks, or unrelated profiling. Bleanx's own obligations concerning lawful disclosure, minimization, confidentiality, security, international transfers, retention, and individuals' rights remain applicable. A reference to provider terms does not replace a required lawful basis, permission, or binding processing arrangement. Further details of the respective mail-processing roles are set out in the Privacy Policy.
The licenses and permissions elsewhere in these Terms do not create any additional exception to this provision. In particular, accepting these Terms, authorizing an AI action, submitting Feedback, or sending a bug report does not authorize Bleanx to use application data for model training or independent product development.
Service Providers: Bleanx maintains a single public provider register called Service Providers on bleanx.com, accessible with these Terms and before the relevant feature is used. It identifies the providers, their separate roles, functions and relevant data, and processing locations and limits. For AI and search, Bleanx identifies the provider used, including a default model, and makes its applicable use restrictions and privacy information available before use. The register also supplies the recipient information referred to in Privacy Sections 3–4 and is incorporated into DPA Schedule C. Bleanx retains its versions and effective dates.
Adding or replacing a subprocessor follows DPA Section 6, including written notice at least 14 calendar days before the affected processing and the opportunity to object. An inventory-only update does not require rewriting unchanged rules in these Terms, the Privacy Policy or DPA. It does not amend those rules, expand the independent-use exceptions in this Section, or replace other required notice, express acceptance, authorization or consent. Section 22 and the applicable Privacy and DPA change procedures remain in effect.
Relevant AI inputs, Output used as context and other necessary information remain subject to Section 1, the Privacy Policy and this Section 4. External search and its distinct data-use terms are governed by "External Search Queries". Provider terms do not displace Bleanx's own obligations.
Service Providers register: Service Providers 2.0
Third-Party Links: Output and search results may contain links to third-party websites. The inclusion of a link does not, by itself, mean that Bleanx endorses the relevant website or has independently verified the accuracy of its content. If you follow such a link, your use of that website and the processing of your data by its operator are governed by that operator's applicable terms and privacy policy, as well as applicable law. This provision does not limit Bleanx's own obligations concerning the Services, security, data protection, or the lawfulness of disclosures of information, and does not affect mandatory user rights.
AI Use Restrictions and Provider Rules: Section 2 applies to the use of AI-powered features, external search, Output, and search results. The following additional rules apply.
(a) Protection of AI Features. Without proper authorization, you must not intentionally use AI-powered features to extract or reproduce non-public system instructions, model parameters, or other protected components of Bleanx or its providers that are not intended for your access, or to circumvent safeguards or access restrictions. This includes such attempts through deliberately crafted user-provided inputs or instructions injected into content processed by the Services.
(b) Model Development. You must not use AI-powered features or the relevant Output to train, fine-tune, distill, or develop AI models to the extent that such use is prohibited by the applicable terms of the relevant provider, including restrictions concerning competing models. Any exceptions and permissions provided under those terms remain applicable. You must not assist others in circumventing those restrictions.
(c) Applicable Provider Rules. When using an AI or external-search feature, or the relevant Output or search results, you must comply with the acceptable-use rules and use restrictions of the AI and search providers applicable to that feature and use. Bleanx identifies the relevant provider and makes the applicable rules and material restrictions available before use of the feature. This reference concerns conduct and use restrictions; it does not incorporate into your agreement with Bleanx all provisions of the commercial agreements between Bleanx and its providers. More permissive provider rules do not override stricter restrictions under these Terms.
This provision does not restrict rights that cannot be excluded by contract. Separately authorized security testing is permitted only within the agreed scope and with any required authorizations from Bleanx and the relevant provider. Ownership of Project materials and Output under Section 1 remains unchanged but does not exempt their use from applicable restrictions. These rules do not grant Bleanx any additional permission to use data for model training or product development and do not relieve Bleanx of its own obligations. Investigations of violations, restrictions, and review of decisions are governed by Section 1.
5. Subscriptions
Purchase Channels: Subscriptions and Usage Credits are purchased either directly from Bleanx through its web service or through Apple In-App Purchase in an available Bleanx app. The common plan, allowance, purchased-credit, one-paid-Subscription and Explorer participation rules below apply to both channels. The Stripe payment, web billing-boundary, renewal-recovery, cancellation, resubscription, and cancellation-followed-by-new-purchase procedures in this Section apply only to direct web purchases. Bleanx does not provide changes of plan within an active direct web Subscription. Apple payment, renewal, cancellation, grace-period, plan-change, and refund procedures are governed by Section 18. General rules for using the Services and mandatory user rights apply regardless of purchase channel.
Geographic Availability of Direct Purchases: Direct purchases from Bleanx are made through bleanx.ai and are available only in the countries and regions available for selection on the Stripe checkout page at the time of purchase, subject to mandatory applicable law. Plans and prices are described on bleanx.com, but no purchases can be made there. These restrictions cover new Founder and Executive Subscriptions, including a new Subscription purchased after an earlier Subscription ends, and separate purchases of Usage Credits. They do not apply to purchases through Apple, which are governed by Apple's terms in the countries and regions where Bleanx is available on the App Store. The effect of a later change in purchase geography on an existing Subscription is addressed below.
Bleanx records the country or region selected and confirmed for each direct purchase. A later change to geographic availability does not, by itself, invalidate a purchase that was eligible when made or retrospectively remove rights acquired through that purchase.
The free Explorer plan remains available worldwide independently of the geographic availability rules for direct purchases, subject to applicable law, including mandatory sanctions and export controls, and the other requirements of these Terms. The purchase restriction does not, by itself, change participation or access rights in another user's Project under Section 1 or limit Bleanx's applicable obligations concerning personal data, AI, and content. The geographic availability rules for direct purchases do not govern Apple In-App Purchases, whose availability and payment procedures are addressed in Section 18.
Location Information and Verification: For direct-purchase eligibility, your location is your usual place of residence, not your nationality or solely the location of a temporary internet connection. Where a purchase for business use is permitted under these Terms, the relevant place of business or receipt of the service is determined under applicable rules. At checkout, you must provide accurate and complete location information, including your country and, for Canada, your province or territory, together with your billing address and other information necessary for the purchase. You must keep that information accurate for subsequent payments.
To verify purchase eligibility, prevent improper payments, and determine the applicable tax treatment, Bleanx compares the information you provide with payment information and necessary technical data, including your IP address. Processing is proportionate to those purposes and governed by the Privacy Policy. Bleanx may request necessary clarification or decline to complete a purchase until material inconsistencies are resolved. A technical mismatch alone does not establish a false declaration or a breach by you. You may correct inaccurate information or contact support@bleanx.org to request review of an erroneous eligibility determination. You must not provide false location information to circumvent purchase restrictions. Neither location nor tax treatment is determined solely by the country selected in a form.
Purchases Accepted in Error: If, after receiving payment, Bleanx establishes that a purchase did not meet the geographic conditions applicable when it was made, Bleanx may cancel that purchase to the extent permitted by law. If Bleanx cancels it on this basis, Bleanx refunds the full amount actually paid for that purchase, including the related taxes, and informs you of the reason and how to seek review of an error. Bleanx initiates the refund under Section 7 without requiring a separate request from you. A subsequent closure of a country or region to new direct purchases does not make an earlier eligible purchase a purchase accepted in error.
Cancellation of that purchase does not automatically delete your account or Projects or cancel rights acquired through other eligible purchases. For a refunded credit top-up, only the unused credit balance attributable to that refunded payment is adjusted; other lawfully purchased Usage Credits are not forfeited.
Changes to Purchase Geography: Bleanx may change geographic availability for future direct purchases in compliance with applicable law. Changes apply to new purchases from the date they take effect, without retrospective effect on earlier eligible purchases. Closing a country or region to new purchases does not, by itself, terminate an existing Subscription or give Bleanx a right under this provision to terminate it. Existing Subscriptions continue under their agreed terms, and Bleanx fulfils the applicable tax obligations relating to their subsequent payments.
If tax must be charged on subsequent Subscription payments and this increases the total recurring amount payable, the notice and express-acceptance procedure in Section 6 applies. Bleanx sends an email at least 30 calendar days before the announced change date and displays the new total, the tax treatment, the relevant dates, the acceptance button, and the consequences of non-acceptance in Settings > Upgrades. If you accept in time, the Subscription continues with the accepted tax-inclusive charge from the applicable Billing Cycle under Section 6. If you do not accept, it continues at the previously agreed amount until the end of the paid month current on the announced change date and then ends with a move to Explorer, subject to any longer notice or other mandatory conditions in Section 6. Your account, existing Projects, and separately purchased Usage Credits are preserved under the applicable access and use rules. Closing new sales does not itself remove your cancellation, withdrawal, or refund rights. Consent arrangements do not postpone or waive Bleanx's own tax obligations.
Plans and Separate Credit Purchases: Bleanx offers the free Explorer plan and the paid Founder and Executive plans ("Subscription Plans"). A paid plan is a "Subscription". Direct web Subscriptions are agreements of indefinite duration from the outset, with monthly advance billing; their monthly Billing Cycle is a payment and resource period, not a fixed contractual term or a new contract concluded each month. For direct web Subscriptions, Cancel ordinarily schedules termination at the end of the paid month; during an unpaid renewal it ends the Subscription immediately, as described below. Apple Subscriptions renew and are managed under Section 18. Your plan determines the limit on Projects you own, available features, and included allowances.
One Paid Subscription per Account: Only one paid Subscription may be active for a Bleanx account at a time, whether purchased through the web or Apple. Bleanx does not make a new paid Subscription purchase available while an existing paid Subscription remains active, within the same purchase channel or across channels. Scheduling cancellation of an already paid period does not end the active Subscription before its effective end date. A pending or unresolved web renewal must be settled or finally closed before another paid Subscription can be purchased. An Apple-managed change between Founder and Executive within the same Subscription group follows Section 18 and replaces or succeeds the applicable plan under Apple's rules; it does not create a second concurrent paid Subscription. A separate Usage Credit top-up is not a second Subscription and remains available subject to the applicable purchase conditions.
Explorer, Existing Projects and Participants: When a paid Subscription ends and the account moves to Explorer, the account, all existing Projects, the access of previously admitted Team participants and Reviewers, and separately purchased Usage Credits are preserved under the applicable access, retention and credit rules. Projects are not deleted merely because their number exceeds Explorer's ownership limit; creating additional Projects remains subject to that limit. Existing participants continue to use the functions permitted by their roles and access, using their own available allowances and separately purchased Usage Credits, not the Project Owner's resources. The owner's move to Explorer does not itself revoke their access or trigger deletion of their Project-related personal AI Dialogue histories.
A Project Owner on Explorer cannot issue new Team invitations. This capability becomes available again when the owner obtains active paid-plan access, subject to the applicable plan limits and access rules. Reviewer requests may be accepted on all plans, including Explorer. The restriction on new Team invitations does not remove existing participants, transfer ownership, or prevent separately authorized revocation of access, moderation or mandatory legal measures. The same rules apply when a web or Apple Subscription ends and when the user later purchases a paid Subscription.
Monthly Usage Allowances: Each paid monthly Subscription period includes two separate allowances (each, a "Monthly Usage Allowance"): an AI allowance covering use of all available AI models, and a web-search allowance. They are entitlements to use the relevant Services during that period, not quantities of Usage Credits or another separately purchased balance. Their absolute size is not stated in credits or other resource units on pricing pages, at purchase, or in the interface. The interface continuously shows the percentage remaining of each allowance separately and its applicable period. The payment and grace-period rules for the relevant purchase channel apply.
Included allowances are not sold separately, are not convertible into Usage Credits or money, and have no separate monetary value. This does not restrict a right to a Subscription refund, price reduction, or other remedy under these Terms or applicable law. These rules distinguish period-based service access from separately purchased Usage Credits and apply to both web and Apple Subscriptions.
Relative Allowances: Explorer's one-time AI Welcome Allowance is the baseline for AI; its separate one-time web-search Welcome Allowance is the baseline for web search. For each monthly period, Founder provides 100 times that AI baseline and 10 times that web-search baseline. Executive provides 300 times the AI baseline and 30 times the web-search baseline. These comparisons concern the full allowance under comparable usage conditions, not a guaranteed number of questions, generations, or completed documents. They compare each paid monthly allowance with the entire corresponding one-time Explorer allowance; they do not make Explorer's allowances monthly. Each percentage indicator shows the remaining share of the applicable allowance.
Explorer Welcome Allowances: A new user receives two separate, free, one-time allowances (each, a "Welcome Allowance"), one for AI and one for web search. Each is shown as a percentage remaining and expires one calendar year after the user's initial registration. Each is provided once per person, is not sold, and has no monetary value. Welcome Allowances are not Usage Credits and cannot be converted into a purchased credit balance. The expiry date and availability are reflected in the interface.
Usage Credits: "Usage Credits" are credits bought separately as top-ups, not included in a Subscription or Welcome Allowance. Their quantity and remaining balance are displayed in credits. They do not expire and are not forfeited solely because a Subscription is cancelled, ends, or changes. A purchase does not change your plan, increase your Project limit, or grant additional Team or Reviewer rights.
When the corresponding included AI or web-search allowance is exhausted or no longer available, consumption in that category uses available purchased Usage Credits under the disclosed consumption rules and Section 4. The AI and web-search allowances are not interchangeable; exhausting one does not use the unspent portion of the other. Use of an existing purchased balance does not authorize a new automatic top-up or charge to a payment method. The same consumption is not deducted twice, and uncovered consumption does not create a user debt. Access permissions and applicable feature restrictions continue to apply.
Before purchase, Bleanx discloses the plan features, the separate AI and web-search allowances and their relative sizes above, consumption factors, monthly Subscription periods and the one-year duration of the one-time Welcome Allowances, purchased-credit terms, and the total amount payable, including applicable taxes. The plan description also explains that new Team invitations require the Project Owner's paid-plan access, while Reviewer requests may be accepted on all plans, including Explorer, and existing Projects and admitted participants are preserved on Explorer as described above. Bleanx explains the one-paid-Subscription rule, the requirement to use Cancel and wait for the existing direct web Subscription to end before purchasing a different web plan, and the separate Apple plan-change procedure. For direct web purchases this information is available on bleanx.com and in Settings > Upgrades, together with any applicable withdrawal information described in Section 7. Apple offers and purchase information are provided under Section 18. A Subscription or credit top-up remains subject to the terms of that purchase. Updating a pricing page, a comparison baseline, or an internal consumption setting does not retrospectively change the purchased entitlement; Section 6 governs changes affecting existing users.
"Subscription Fees" means all fees associated with your Subscription. Additional terms ("Supplementary Terms") may apply to the Subscription you purchase.
Payment Confirmation, Billing Cycles and Resource Periods for Web Purchases: On your initial purchase of a direct web Subscription, the Subscription starts when Stripe confirms successful payment. That time determines the start of the first Billing Cycle and the first monthly resource period. Returning to the Services from checkout or opening a purchase-success page does not, by itself, confirm payment.
Billing Cycles: Your Subscription is paid in advance for each monthly billing period (the "Billing Cycle") under the continuing Subscription agreement. The Billing Cycle and monthly resource period coincide and last one calendar month, subject to the calendar-boundary rule below. The first period starts when Stripe confirms the initial successful payment. Subsequent periods remain anchored to that Subscription start date. After that Subscription has ended, a new purchase confirmed by Stripe establishes a new monthly Billing Cycle and billing anchor date as described below. When payment for the next Billing Cycle is confirmed, including during the permitted recovery window, that paid period runs from the original scheduled renewal boundary rather than the later confirmation date. A fresh set of Monthly Usage Allowances is made available only after successful payment confirmation; unused amounts from the preceding paid period do not carry over. Starting a new Billing Cycle does not, by itself, conclude a new Subscription contract or extend a fixed contractual term.
Monthly Subscription Periods: For direct web Subscriptions, if the original day of the month does not exist in a particular month, the monthly period boundary falls on that month's last day; the original day is used again in later months whenever it exists. A monthly period is anchored to the Subscription, not necessarily to the first day of a calendar month. AI and web-search Monthly Usage Allowances are provided for each monthly Subscription period, subject to the applicable payment and grace-period rules. Separately purchased Usage Credits retain their non-expiring status. Apple period dates and grace handling follow Section 18.
Separate Withdrawal Period: The Billing Cycle and monthly resource periods do not determine or replace the period for exercising a right to withdraw from the contract. The right of withdrawal, calculation of its period, and conditions for starting the service before that period ends are governed by Section 7. Payment confirmation does not, by itself, replace any required express request by the user for immediate commencement of the service.
Continuing Subscription and Recurring Payments: A Subscription purchased directly from Bleanx through its web service continues under the same agreement until it ends under the cancellation, failed-payment, or termination provisions of these Terms and applicable law. Unless cancellation has stopped renewal, Stripe generates the next monthly invoice and makes an authorized attempt to collect the disclosed Subscription Fees and applicable taxes after the invoice is ready, which may be later than the scheduled monthly boundary. If that attempt fails, the limited retry process below applies unless you cancel or applicable law prevents further collection. References to "renewal" or "auto-renewal" describe recurring monthly payments and allowances under the continuing agreement, not a new fixed-term contract.
Subscription Disclosure and Consent for Web Purchases: Before you accept the continuing direct web Subscription offer, and before requesting or confirming billing information where required by law, Bleanx clearly and conspicuously discloses its indefinite duration, monthly recurring charges, and how and when cancellation takes effect, including how the single Cancel action operates during a paid period and during an unpaid renewal. Bleanx obtains your express affirmative consent to the disclosed continuing-service and recurring-payment terms and retains evidence for the legally required period. Bleanx promptly emails confirmation of the accepted terms, charges, frequency, and cancellation methods in a form you can retain. Consent to recurring payments is not inferred merely from providing payment information or requesting that the service start during a statutory withdrawal period.
Required Notices for Continuing Subscriptions: Bleanx sends the periodic reminders, payment-related notices, and notices of material changes required by applicable law for the continuing Subscription, within the applicable notice windows and through the required or validly selected communication channel. The notices identify the Subscription, the relevant billing or cancellation date where applicable, the recurring charge and frequency, and how to cancel, including an accessible cancellation link or other legally permitted electronic route. These service notices are not conditional on consent to marketing messages. Indefinite duration, monthly billing, and the availability of online cancellation do not dispense with a legally required notice or consent.
A valid payment method, including credit card, is required to process payment for your direct web Subscription. You must provide Bleanx with accurate and complete billing information including full name, address, state, zip code, and valid payment method information. Recurring charges require your express affirmative consent to the disclosed continuing-service and recurring-payment terms. Merely providing billing or payment information is not, by itself, that consent. Charges for a Subscription are limited to the payment authorization for that Subscription.
Failed Renewal and Web Grace Period: If the first Stripe payment attempt for a new monthly period fails, Stripe is scheduled to retry once one day after that attempt and, if payment remains unsuccessful, once more two days after the preceding retry. The temporary recovery window extends for up to 72 hours from the first failed attempt; while its exact time cannot be reliably established, the window is provisionally measured from the end of the preceding paid period. Payment-method limitations or required payment authentication may prevent a scheduled retry from being charged. The window is not restarted by signing in, reopening the Services, or receiving another payment notification.
While renewal payment is outstanding, Bleanx temporarily preserves the preceding plan's capabilities and only the unused AI and web-search allowances remaining from the preceding paid period. Those remaining amounts may be used during the window, but no new monthly allowance is granted until payment is confirmed; separately purchased Usage Credits remain available under their existing rules. Once Stripe confirms an eligible renewal payment, the new monthly allowances are granted once for the period anchored to the original scheduled renewal date; any unused preceding-period allowance ends without being added to the new allowance. Consumption already accounted for is not charged twice.
If all permitted attempts fail, Bleanx closes the unpaid renewal invoice and terminates the Subscription; once that closure is confirmed, your account moves to Explorer. If the recovery window ends while the final payment or closure status is still unconfirmed, temporary paid-plan access ends, but Bleanx does not treat the old Subscription as conclusively closed or allow a second paid Subscription until the outstanding status is resolved. You may still use Cancel as described below. A delayed confirmation of an eligible payment is applied to the proper Billing Cycle, subject to the cancellation and refund rules. Your account and Projects are not deleted, existing participants' access is preserved under the Explorer rules, and separately purchased Usage Credits remain available.
Late Web Renewal Payments: A delayed confirmation of a valid renewal payment made before the Subscription was terminated applies to the Billing Cycle anchored to the original scheduled renewal boundary. After the Subscription has been terminated, any payment collected in error for its expired renewal is refunded without a separate request and does not reactivate that Subscription. New paid access requires a separately confirmed purchase. This does not limit other refund rights under Section 7.
Web Subscription Cancellation: A single "Cancel" action is available in the Subscription management area of bleanx.ai for direct web Subscriptions. Before your final confirmation, Bleanx explains whether cancellation will take effect at the end of an already paid period or immediately because the next renewal is unpaid.
Cancel During a Paid Period: Choosing Cancel while the current monthly period is paid stops further automatic renewal and schedules the Subscription to end at the end of that paid period. Paid-plan access and any unused AI and web-search allowances for that period continue until its end under the resource rules. When the scheduled termination takes effect, your account moves to Explorer. No separate voluntary immediate mid-period cancellation option is offered through this control; applicable mandatory termination and refund rights remain unaffected.
Cancel During an Unpaid Renewal: Choosing Cancel while a renewal payment is outstanding during the recovery window stops the recovery of that payment and requests immediate termination of the Subscription and closure of its unpaid renewal invoice. Once that termination is confirmed, temporary paid-plan access ends and your account moves to Explorer. You do not need to wait for the remaining retry attempts. The different effect of this action is explained before you confirm it.
Cancel can be completed online without contacting support, making a telephone call, obtaining staff approval, or deleting your account. Bleanx does not impose obstructive steps or unnecessary delays. Bleanx records each cancellation request accepted by the Services, and, if the outcome is not yet confirmed by Stripe, informs you that cancellation is pending rather than representing it as completed. After confirmation, Bleanx promptly sends an email you can retain recording the action, its submission date and time, the effective end date, and its consequences, subject to any shorter mandatory notice period. If a charge for that Subscription is collected after Bleanx has recorded your cancellation request, Bleanx refunds that charge. You may also contact support@bleanx.org, without being required to do so to use Cancel.
Using Cancel does not delete your Bleanx account or existing Projects, including those above the Explorer limit, revoke the access of previously admitted Team participants or Reviewers, or forfeit separately purchased Usage Credits merely because the paid Subscription ends. Existing-participant continuity, the restriction on new Team invitations, and limits on creating new Projects follow "Explorer, Existing Projects and Participants" above. Other features and resource use remain subject to the applicable plan, resource-validity, and access rules.
Cancellation methods required by law remain readily accessible throughout the contract. Where required, Bleanx provides a directly accessible cancellation function from its public website, the required confirmation step and electronic acknowledgement, and appropriate alternatives for users unable to access their account. Cancellation is available through the channels required by applicable law.
Using Cancel under this Section is distinct from exercising a statutory right of withdrawal under Section 7, where applicable law provides it. The applicable withdrawal period is normally the first 14 days following conclusion of the relevant contract, subject to statutory exceptions and extensions. Cancelling renewal, exercising statutory withdrawal, requesting a refund, and deleting an account are separate actions. Using Cancel does not waive rights under Section 7 or applicable law; a valid statutory withdrawal does not depend on using a particular button label.
Account Deletion and Recurring Payments: If you delete your account under Section 12, auto-renewal of your direct web Subscription is cancelled and future recurring charges stop without a separate cancellation action. Your account is deleted rather than retained on Explorer. Refunds are governed by Sections 7 and 12. Conversely, selecting Cancel does not, by itself, delete your account or Projects.
Re-enabling Recurring Payments: After using Cancel during a paid monthly period, and before that period ends, you may select "Resubscribe" in the Subscription management area of bleanx.ai to restore automatic renewal of that same continuing Subscription. This reverses the scheduled cancellation and does not constitute a new purchase.
Resubscribe does not trigger an immediate charge, change the current Billing Cycle or billing anchor date, replenish monthly allowances, or grant Usage Credits. The next charge follows the original scheduled renewal date and applicable payment rules.
Before you confirm Resubscribe, Bleanx displays the applicable plan, the amount and frequency of future charges, and the next scheduled payment date. Restoring recurring payments requires your express action; it does not occur merely because you sign in or continue using the Services. The disclosure, consent and confirmation requirements under "Subscription Disclosure and Consent for Web Purchases" apply.
Once the scheduled end of a paid period has taken effect, or an unpaid renewal has been terminated, the previous Subscription cannot be restored through Resubscribe. Paid access requires a new purchase after the preceding Subscription has finally ended. An unresolved payment or termination status does not authorize a second concurrent paid Subscription.
Changing a Web Plan by Ending the Existing Subscription: Bleanx does not provide an upgrade or downgrade within an active direct web Subscription. To purchase a different web plan, you use Cancel, retain the existing paid plan until its current paid period ends, and then make a separate new purchase after that Subscription has ended. Cancelling the existing Subscription does not itself purchase another plan.
After Cancel during a paid period, the existing Subscription remains active until that period ends; no new paid Subscription may be purchased before its confirmed end. The normal Cancel process does not terminate an already paid period immediately merely to change plans. The new purchase is separately confirmed and remains subject to the one-paid-Subscription rule and applicable purchase conditions. Statutory withdrawal, refunds, and other mandatory rights under Section 7 remain unaffected.
For a new direct web Subscription, successful payment confirmed by Stripe starts a new monthly Billing Cycle, monthly resource period and billing anchor date. No unused prepaid time from the ended Subscription is applied as a price offset to the new purchase. Account, Project, existing-participant and purchased-credit continuity while on Explorer follows "Explorer, Existing Projects and Participants" above.
This procedure concerns direct web Subscriptions only. Changes between Founder and Executive within Apple's Subscription group remain governed by Section 18. The one-paid-Subscription rule and the Explorer participation rules apply to both purchase channels.
Mandatory Cancellation Rights: Bleanx honours statutory cancellation and refund rights, including any rights arising from a missing or defective required notice or cancellation mechanism. The absence of an ordinary immediate mid-period cancellation option does not override those rights or Section 7. These protections prevail over inconsistent renewal, payment, fee-change, or cancellation provisions in these Terms.
6. Fees and Fee Changes
Purchase Channels and Scope: The price-change acceptance process and direct-purchase tax rules in this Section apply to direct web purchases. Apple purchase pricing, billing, and price-change procedures are set out in Section 18. "Protection of Allowances and Consumption Rules" below applies to Subscriptions in both channels and is not displaced by Apple's separate billing procedures. Mandatory rights and Bleanx's own legal obligations remain applicable.
Prices for New Purchases: For purchases made directly from Bleanx through its web service, the price of a new Subscription or separate purchase of Usage Credits is the price disclosed before you confirm the purchase, with the total payable disclosed as required under Section 5 and applicable law. Changes to the price or purchase rate of separate credit top-ups apply only to future purchases. They do not reduce the number of Usage Credits already purchased, introduce an expiry date for them, or otherwise change the rights acquired with that purchase.
Price Increases for Existing Web Subscriptions: Bleanx may propose a higher price for an existing direct web Subscription, but may apply it only with your express acceptance of that specific higher price. At least 30 calendar days before the announced change date, Bleanx sends you an email and displays the proposal in Settings > Upgrades, together with a clearly labelled acceptance button. The notice and display identify the current and proposed prices, the monthly charging frequency, the announced change date and acceptance deadline, the first Billing Cycle to which the higher price would apply, and how to cancel. They also clearly state the consequence of non-acceptance and your individual Subscription end date in that event. The email serves as advance notice from Bleanx of that conditional termination, subject to mandatory law.
Acceptance and Application: If you expressly accept by the stated deadline using the acceptance button, the higher price applies from the first Billing Cycle beginning after the announced change date, subject to all required notices having been provided. It does not alter the price of a period already paid for. Acceptance does not itself trigger an immediate charge, change the current Billing Cycle, grant purchased Usage Credits, or reverse a cancellation you have already requested. Bleanx records your acceptance and promptly emails confirmation of the accepted price, its first application date, charging frequency, and cancellation methods in a form you can retain. Continued use of the Services, silence, payment details already held by Bleanx, or a general acceptance-of-changes provision elsewhere in these Terms does not constitute acceptance of the higher price.
If the Higher Price Is Not Accepted: If you do not accept by the announced change date, your Subscription continues at the existing price until the end of the paid month current on that date and then ends, as identified in the notice. No further recurring Subscription charge is made after that end date, and your account moves to Explorer. Bleanx emails confirmation of the end date and its consequences. Non-acceptance is not a breach of these Terms. It does not delete your account or existing Projects or forfeit separately purchased Usage Credits; the applicable Explorer limits and access rules apply after the paid Subscription ends. Your existing cancellation and refund rights remain available. If mandatory law requires a longer termination notice period or other termination conditions, Bleanx complies with them before ending the Subscription, and the existing price continues until the lawful end date.
Price Reductions: A reduction in the price applicable to your existing Subscription is applied automatically from the next Billing Cycle without requiring your acceptance. Bleanx provides any notice required by applicable law. If a mandatory advance-notice period prevents application at that next boundary, the reduction applies at the earliest subsequent monthly boundary permitted by that requirement; no acceptance is required for the reduction.
Additional Notices and Mandatory Rights: The 30-day proposal notice does not replace any additional or differently timed notice required by applicable law. Bleanx provides required fee-change notices within the applicable minimum and maximum notice windows, measured against the date when the changed price applies to your Subscription, with clear cancellation information in a form you can retain and through the required or validly selected channel. If the initial proposal notice does not satisfy those requirements, Bleanx sends an additional notice. Your acceptance does not waive a mandatory notice requirement. No higher price is charged before the required acceptance and notice conditions are satisfied. These rules govern changes to an existing Subscription's price proposed by Bleanx, not the separately confirmed price of a new Subscription purchased after an earlier Subscription has ended under Section 5. They do not authorize undisclosed changes to plan features or resource-consumption rules. No other provision of these Terms overrides the express-acceptance requirement or mandatory cancellation, termination, or refund rights.
Protection of Allowances and Consumption Rules: During an already paid period, Bleanx does not reduce either Monthly Usage Allowance or change accounting rules so that comparable actions under comparable conditions consume a greater share of it. This protection covers the actual allowance base and consumption weights, not merely the displayed percentage or ratio. Changes in internal calculations, the Explorer comparison baseline, or provider prices do not authorize a reduction of the already paid entitlement. Different consumption attributable to a user's selected model or overall request context under the disclosed rules is not, by itself, a change to those rules.
For an existing Subscription, a proposed reduction of either allowance, expansion of the activities counted against it, or other adverse change to consumption rules requires at least 30 calendar days' advance notice and your separate express acceptance before it can apply to a future monthly period. Bleanx explains the current and proposed rules and their practical effect, the application date, acceptance deadline, and consequences of non-acceptance by email and in the relevant Subscription settings. Any additional mandatory notice, lawful contractual basis, or statutory remedy remains required. The change does not reduce an already paid period.
Accepting a price change alone is not acceptance of an adverse allowance change. Silence, continued use, or a general changes provision is not the separate acceptance required here. Bleanx records acceptance and provides confirmation in a form you can retain. Acceptance does not itself change the current Billing Cycle, grant purchased Usage Credits, or reverse a requested cancellation.
For a direct web Subscription, the notice, application-date, and non-acceptance process for an existing web price increase above applies correspondingly: without acceptance, the existing entitlement continues until the disclosed lawful end date, with no further recurring charge thereafter. Non-acceptance is not a breach and does not delete the account or Projects or forfeit purchased Usage Credits. For an Apple Subscription, existing agreed entitlements remain in effect until a validly accepted change or lawful termination under the applicable process. A Bleanx acceptance control, or failure to use it, does not itself cancel Apple billing. Bleanx must coordinate any termination with the applicable Apple and legal requirements rather than continue charging for an unaccepted reduced entitlement.
These protections prevail over inconsistent general changes language, including Section 22. They do not restrict mandatory rights concerning modification, conformity, termination, price reduction, or refunds, and do not authorize unlawful unilateral changes. Separately purchased Usage Credits retain the rights acquired with their purchase.
Taxes and Total Price: For direct web purchases, base prices of Subscriptions and separately purchased Usage Credits are stated before applicable indirect taxes only where that presentation is permitted by law. Where consumer-pricing rules require a tax-inclusive price, Bleanx displays the required total price, including in the offer or advertising where required.
Bleanx calculates, collects, and remits VAT, GST, sales tax, use tax, and comparable indirect taxes on the relevant transaction where and as required by applicable law. Tax treatment depends on the transaction, the customer's location and verified status, and applicable exemptions or self-assessment rules. A tax registration does not, by itself, mean that every purchase is taxable.
Before you confirm a purchase, Bleanx displays the total amount payable, including applicable taxes. Tax already included in a displayed price is not added a second time. The purchase confirmation or relevant payment document identifies the tax in the manner required by law.
Business Purchases: Where a purchase is made for business use permitted under these Terms, you must provide the relevant tax identification number and information necessary to verify the tax status and transaction. Reverse charge, exemption, or another special treatment applies only where its legal conditions are met. A tax identification number alone does not guarantee tax-free treatment or permit a purchase from an unavailable country or region. Providing tax information does not, by itself, change the party to these Terms or ownership of a Project.
Where applicable law requires the purchaser to self-assess tax, the purchaser must fulfil that obligation. This does not transfer Bleanx's own registration, calculation, collection, or remittance obligations to the purchaser.
Tax Changes on Existing Subscriptions: The advance-notice, express-acceptance, application-date, and non-acceptance rules earlier in this Section 6 also apply where the collection of applicable tax increases the total recurring amount payable for an existing Subscription, including when a country or region is closed to new purchases under Section 5. The notice and acceptance relate to the new total payment, not merely the price before tax. Tax is separately identified or shown as included in the price as required by law. A change in tax treatment does not authorize a retrospective increase in an already paid period or an additional charge not properly disclosed and accepted. Statutory tax obligations remain Bleanx's responsibility while the notice and acceptance process is completed; mandatory user rights and applicable notice requirements remain unaffected.
7. Refunds
Purchase Channels: The ordinary manual payment-refund procedure and the procedure for submitting a statutory withdrawal statement to Bleanx in this Section concern direct web purchases. Apple purchase refunds and purchase-management routes are addressed in Section 18. This distinction does not exclude applicable statutory withdrawal or conformity remedies, require repetition of a valid legal notice, or relieve Bleanx of its own mandatory obligations. The substantive protections below apply where the relevant law requires them.
Refund Requests: For purchases made directly from Bleanx through its web service, including Subscriptions with monthly billing and separate purchases of Usage Credits, you may request a refund by contacting support@bleanx.org. Your request should identify the relevant account, purchase, and payment or unused balance for which a refund is requested. Bleanx requests additional information only to the extent necessary to assess the request. No reason is required to exercise a statutory right of withdrawal.
Manual Review and Payment: Except for refunds that Section 5 requires Bleanx to initiate without a separate request, refund requests are reviewed by Bleanx staff, and refunds that are due are processed manually. The review takes account of the basis of the request, confirmed payment, the services provided or unused paid balance concerned, previous refunds, and related payment disputes. Bleanx informs you of the outcome and, as applicable, the refund amount and basis of calculation or the reason for refusal.
Mandatory Rights: This procedure does not limit statutory rights of withdrawal, remedies for failure to supply or lack of conformity of the Services, or other rights that cannot be excluded by contract. Bleanx complies with applicable mandatory refund deadlines, amounts, payment methods, and prohibitions on refund fees. Manual review does not suspend those deadlines. A validly submitted statutory notice or claim need not be repeated in a separate email. Where a refund obligation arises without an additional user request, Bleanx does not make compliance conditional on such a request. Other mandatory rights apply notwithstanding any contrary provision of these Terms.
Geographic Restrictions and Refund Rights: Geographic restrictions on direct purchases do not exclude mandatory rights applicable to a concluded contract. They do not prevent cancellation, statutory withdrawal, a refund request, or access to the channels provided for those purposes, including where a purchase was accepted in error or the country or region is later closed to new purchases.
Refunds under "Purchases Accepted in Error" in Section 5 are initiated by Bleanx and processed manually under this Section without a separate user request. The full-refund commitment for a purchase cancelled by Bleanx on that basis is not reduced by the ordinary rules for voluntary cancellation or payment for performance before a user-initiated statutory withdrawal. The separate no-request refund obligations for erroneous post-termination and post-cancellation charges in Section 5 remain applicable.
Statutory Right of Withdrawal: Where applicable consumer law provides a right to withdraw from a distance contract, you may exercise that right without giving any reason within 14 calendar days of the conclusion of the relevant contract, subject to applicable statutory exceptions and any longer period or extension required by law. This applies to eligible purchases of Founder or Executive Subscriptions with monthly billing and each separate credit top-up. A statutory withdrawal is distinct from using Cancel under Section 5, requesting a refund, or deleting an account.
To withdraw, submit an unequivocal statement identifying the relevant contract by email to support@bleanx.org or by post to Bleanx at the address in Section 26. You may use the model form below, but doing so is not mandatory. Sending your statement before the applicable deadline is sufficient to exercise the right in time. A valid statutory withdrawal does not depend on Bleanx approving a refund request.
Starting Services During the Withdrawal Period: Where a statutory right of withdrawal applies, you may expressly request at direct web checkout, through a separate checkbox, that Bleanx begin providing the purchased service before the withdrawal period ends. If you then lawfully withdraw, you pay only the proportionate amount legally due for performance up to the time you inform Bleanx of your withdrawal, compared with the full coverage of the contract. The agreed total price is the basis, or, if that price is excessive, the market value of what was provided. No payment for early performance is due where applicable law excludes it, including where required prior information or a valid express request was not obtained.
For Bleanx's combined monthly Subscription service, the proportionate amount is calculated by the duration of service provided before notice of withdrawal, using the agreed price for the corresponding period and the applicable mandatory calculation rules. The percentage of an AI or web-search allowance used is not the percentage of the whole Subscription performed. Exhausting either or both allowances is not, by itself, full performance of the monthly service. Bleanx does not retrospectively convert included use into a purchase of Usage Credits or add separately unagreed AI-provider costs. Separate top-up purchases and any performance lawfully attributable to them are assessed separately, without charging for the same performance twice.
Requesting an immediate start does not itself waive withdrawal. Any loss of the right following full performance requires all applicable statutory conditions, including the required prior express consent and acknowledgement. Activating a Subscription, making its allowances available, or recording a purchased credit balance is not, by itself, full performance of the purchased service. More favourable mandatory rights remain unaffected.
Bleanx sends an acknowledgement by email without undue delay, including the content of the withdrawal statement and the date and time of its submission. The submission time determines whether the statement was sent within the withdrawal period. The acknowledgement is not an approval process, and you do not need to send a separate refund request to support after submitting the withdrawal. Bleanx staff process the resulting refund manually under this Section. Email, post, and other legally permitted means of withdrawal remain available.
Where a statutory right of withdrawal applies, before the purchase contract is concluded the checkout information explains the applicable withdrawal conditions, time limit and procedure, and makes the model withdrawal form available. Bleanx provides the required contractual information on a durable medium within the applicable time limit and no later than the start of the purchased service.
Refund Following Statutory Withdrawal: Bleanx reimburses the payments covered by a valid statutory withdrawal, subject only to amounts lawfully payable for performance before withdrawal, without undue delay and no later than 14 days after being informed of the withdrawal. Reimbursement uses the original means of payment unless you expressly agree otherwise, without a fee for the reimbursement. These rules do not limit any more favourable mandatory rights or other refunds due by law. A refund request outside a statutory withdrawal period is assessed on its applicable contractual or legal grounds. The Cancel procedure in Section 5 does not limit any refund due under this Section or applicable law.
Model Withdrawal Form (use is optional): Complete and send this form only if you wish to withdraw from the contract.

8. Communications from Bleanx
Service Messages: Bleanx currently sends only messages necessary to provide, administer, or protect the Services, including messages concerning your account and security, purchases and payments, your Subscription and changes to it, support requests and reports of violations, changes to these Terms, and other notices required by applicable law or these Terms. These service messages are not conditional on consent to marketing messages. While your account or Subscription remains active, you cannot opt out of necessary service messages, except where applicable law or applicable platform rules require an opt-out or other choice. Bleanx complies with applicable requirements concerning the content, delivery, and opt-out mechanisms for such messages.
Marketing Messages: Bleanx does not currently send marketing messages. Creating an account, accepting these Terms, or making a purchase does not constitute consent to marketing. If Bleanx introduces marketing communications in the future, it will send them only to recipients who have separately and voluntarily given specific, informed, affirmative consent to the relevant communications. Consent will not be a condition of creating an account or making a purchase. Each marketing message will identify Bleanx and include a clear, easy, and free way to unsubscribe. You may withdraw marketing consent at any time, and Bleanx will give effect to that choice in accordance with applicable law. Unsubscribing from marketing does not affect your access to the Services or necessary service messages, subject to mandatory rights under applicable law.
9. Copyright Policy
We respect the intellectual property rights of others. Copyright complaints concerning materials made available through the Services may be sent to support@bleanx.org. Bleanx reviews these complaints, takes any resulting measures, and handles requests for review under the reporting and moderation procedures in Section 1 and applicable law.
10. Intellectual Property
Bleanx and its licensors retain the intellectual property rights they hold in the Services and Bleanx Content to the extent recognized by applicable law, subject to the licenses and permissions expressly granted under these Terms.
These rights may include, to the extent protected by applicable law:
The Bleanx name, logo, and all related names, logos, product and service names, designs, and slogans;
The software, Module structures, system instructions, system prompts, and other pre-configured Project structures provided by Bleanx, excluding User Content and Output;
The hierarchical system of Contours, Modules, and Sections, but not the User Content or Output created or contributed within that structure;
The user interface and visual design of the Services.
Third-Party AI Technologies: Bleanx uses the services of external AI providers for its AI-powered features. Rights in third-party AI models and associated technologies remain with their respective rights holders. Using those services does not transfer ownership of those models to Bleanx.
Rights in User Content and Output are governed separately by "Content Ownership" in Section 1 and "Rights in Output" in Section 4. This Section does not change that allocation of rights or expand the licenses or permissions granted to Bleanx to process those materials. Creating, processing, or storing User Content or Output through the Services does not, by itself, make it Bleanx Content. Rights in elements of Bleanx Content and third-party materials incorporated into those materials remain subject to those provisions.
Use of Bleanx Content is governed by "Limited License to Bleanx Content" in Section 1. This Section does not restrict the use or export of Project materials permitted by Section 1 or grant additional rights to extract or use Bleanx Content independently.
Use of Bleanx's trademarks or trade dress in connection with a product or service requires Bleanx's prior written consent, except where expressly permitted by these Terms or applicable law.
11. Feedback
For purposes of these Terms, "Feedback" means suggestions, comments, support requests, and bug reports provided to Bleanx. Bug reports and any accompanying materials are handled only as described under "Voluntary Bug Reports" in Section 4. Providing Feedback does not transfer ownership of its contents to Bleanx or create an exception to "No Training or Product Development Use of App Data". Project materials remain subject to the ownership, access, and limited processing rules in Section 1.
12. Termination
Suspension and Termination: Bleanx may suspend or terminate your account or access to the Services in accordance with these Terms and applicable law. The applicable grounds, notice requirements, and review procedures under Sections 1 and 3, and your rights under Section 7, remain unaffected.
Deletion of Projects you own, removal of User Content and saved Output, and the related retention of data are governed by Section 1, this Section 12, and the Privacy Policy. Termination of access does not, by itself, reverse a transfer or grant of rights under "Content Ownership" in Section 1 or transfer Project materials to Bleanx.
Deletion of Inactive Accounts: Bleanx deletes an account after 24 consecutive months without signing in, unless the account has an active Subscription or a positive remaining balance of separately purchased Usage Credits. Either exception prevents automatic deletion for inactivity, regardless of whether the Subscription or credits were purchased directly through the web service or through Apple.
Bleanx sends a warning to the email address associated with the account 30 calendar days before the scheduled deletion. The warning identifies the deletion date, explains the irreversible consequences and the available export options, and explains that signing in before deletion prevents deletion for inactivity.
Any new sign-in before the scheduled deletion cancels that deletion for inactivity and starts a new 24-month inactivity period. Before deletion, Bleanx checks again whether the account remains inactive and whether either exception applies. Deletion does not take place before both the 24-month inactivity period and the full 30-day warning period have elapsed.
Deletion for inactivity has the same effects as account deletion by you under this Section, including immediate removal from operational systems without a recovery period. The rules below concerning owned Projects, other users' Projects, personal content, retained correspondence, limited lawful retention, external providers, and refunds apply. Mandatory data-retrieval periods and lawful preservation requirements remain applicable.
The inactivity exceptions do not prevent you from deleting your account yourself while a Subscription is active or purchased Usage Credits remain. They do not authorize indefinite retention of unrelated records or postpone earlier erasure required by law.
Account Deletion by You: You may delete your account through Settings > Account > Delete account. Before your final confirmation, Bleanx explains the consequences for your account, Projects you own, other users' access, your personal content, your Subscription, and unused paid resources.
You do not need to contact support to use this deletion function. If you cannot use it, for example because you have lost access to your account, you may contact support@bleanx.org. Bleanx may carry out necessary and proportionate verification of the requester's identity.
Upon your final confirmation, your account and Projects you own are immediately deleted from the operational systems of the Services. There is no recovery period, and restoration of the deleted account and those Projects is not provided. This does not mean the immediate destruction of records that must lawfully be retained or all residual backup copies, as described below.
Effects on Projects and Other Participants: Team participants and Reviewers immediately lose access to your deleted Projects, and those Projects disappear from their Project lists. In the ordinary deletion process, Bleanx does not send them a separate notification of that loss of access. Their accounts and Projects they own are not affected.
Your access to Projects owned by other users ends. Those Projects and contributions you have made as Project content are not deleted solely because you delete your account. The contributions remain with the relevant Project Owner in accordance with "Content Ownership" in Section 1. Account deletion does not reverse a transfer or grant of rights already made under that provision or transfer those rights to Bleanx.
In retained Project records, including the display of authorship in the Journal, your profile name and image are replaced by the neutral designation "Deleted user". This change to the display of your profile does not mean that all information about you contained within Project materials has automatically been erased or anonymized.
Personal Content and Correspondence: Your personal Ask and AI Dialogue content, including the associated saved questions and responses, is deleted with your account. It is not transferred to the Project Owner or other Project participants. Personal AI Dialogue history associated with a Project is also deleted earlier if you leave that Project, lose access to it, or the Project is deleted, as described under "Removal and Retention of User Content" in Section 1. A later invitation or renewed access does not restore that deleted history.
After your account is deleted, direct Dialogue correspondence retained by the other participant remains in that person's correspondence until they delete it using "Delete for me" or their own account is deleted, whichever occurs first, subject to earlier required erasure under "Personal Data in Retained Content" below. The neutral designation "Deleted user" is displayed instead of your profile name and image; this does not anonymize all personal data within the correspondence. Retaining that correspondence does not make it Project content or give other participants or the Project Owner access merely because of their role.
Personal Data in Retained Content: Retention of Project contributions or correspondence does not override applicable personal data protection rights. Personal data in those materials may be processed only on an appropriate lawful basis, to the extent necessary, and for a justified period.
You may contact support@bleanx.org to request erasure of your personal data from retained Project content or correspondence without restoring your account. Bleanx assesses the request in light of applicable law, its role in the relevant processing, the rights of other persons, and applicable legal exceptions, and carries out any required erasure, redaction, or restriction of processing.
You do not need to repeat a valid request that already covers the relevant data. These provisions do not authorize retention of data that must be erased independently of any additional request. The provisions concerning retention of content do not limit deletion that Bleanx is required to carry out under applicable law or applicable rules of an app distribution platform.
Subscriptions and Purchased Credits: Account deletion cancels auto-renewal of a Subscription purchased directly from Bleanx through its web service and stops future recurring charges for that Subscription. You do not need to select Cancel separately beforehand. Access to the account and paid features, including further use of the included allowances, ends with account deletion. Remaining portions of included allowances are not converted into money or Usage Credits; this does not exclude separate Subscription refund or other remedy claims.
Refunds of payments and the unused paid portion of separately purchased Usage Credits are governed by Section 7 and "Refunds on Account Deletion or Termination" in this Section 12. Deletion does not require you first to use your remaining credits or wait for a refund review, and does not remove your right to submit a request after account closure.
For a Subscription purchased through Apple, deleting your Bleanx account or uninstalling the app does not, by itself, cancel the Apple Subscription. Before account deletion, Bleanx warns you about possible continuing charges, offers a route to manage or cancel the Subscription through Apple, and provides the route to request an Apple purchase refund under Section 18. An active Apple Subscription does not prevent immediate deletion of your Bleanx account. The scope and availability of Apple-distributed applications are governed by Section 18.
Necessary Retention and External Providers: After account deletion, Bleanx retains only data for which a necessary lawful basis for retention exists, including required financial and tax records, information necessary for settlements and refunds, the handling of complaints and legal claims, and security records whose retention is reasonably necessary. The scope and duration of retention are limited to the relevant purpose and applicable law and are described in the Privacy Policy.
Residual copies in backup systems are deleted under the limited retention and overwrite schedule described in the Privacy Policy. Until deletion, they are protected against ordinary use. If infrastructure is restored, previous deletions are reapplied so that deleted data is not returned to operational processing.
Bleanx takes the necessary steps to arrange deletion by processors acting on its behalf and to notify other recipients of data where required by law. Deleting a Bleanx account does not, by itself, mean that every external provider's records are simultaneously erased. Their processing and your applicable rights are described in the Privacy Policy. Retained data is not used for new unrelated purposes, model training, or product development contrary to the restrictions in Section 4.
Refunds on Account Deletion or Termination: If you delete your account or Bleanx permanently terminates access, including for a breach of these Terms, you retain the right to request a refund of the unused paid portion of separately purchased Usage Credits. For direct web purchases, contact support@bleanx.org under Section 7. Apple purchase requests follow Section 18; Bleanx support remains available to assist and address Bleanx's own obligations. Requests concerning Subscription payments are assessed separately under Sections 7 and 18 and applicable law. An unused Monthly Usage Allowance or Welcome Allowance is not a refundable purchased-credit balance, but that distinction does not remove a separate right to a Subscription refund or another remedy.
Account deletion or termination of access does not itself initiate an automatic payment and does not deprive you of the right to request a refund or receive a refund due under these Terms or applicable law. Making a request and completing the settlement do not require restoration of account access. Account deletion is not conditional on first using your remaining credits or completing the review of a refund request.
When Bleanx permanently terminates access to your account, its notice includes information about the option to request a refund and the address support@bleanx.org. Review of a refund request does not replace the opportunity to challenge an access restriction under Section 1.
Bleanx retains only the information necessary to review the request and complete the settlement, in accordance with the Privacy Policy and applicable law.
Export of Data: You may immediately generate a complete package of your account data and all Projects you own using "Export all user data" in Settings > Account, or obtain the same export programmatically using an access key that you create and may revoke, as described in "Account Data, Access and Portability" in Section 1. Separate export of a Project you own remains available in Settings > Project in Markdown, PDF, and JSON under "Export of Project Materials" in Section 1. Support at support@bleanx.org is an alternative channel for obtaining the package or resolving export issues, not a prerequisite for the full export.
Downloading data, creating or using an export key, or requesting a copy through support does not, by itself, cancel a Subscription, terminate a contract, delete your account or Projects, or start a period after which they will be deleted. We recommend obtaining any data you need before confirming irreversible deletion. This recommendation does not limit mandatory rights of access, retrieval, or portability. A request for a copy is distinct from the switching process below and from immediate account deletion.
Switching under the EU Data Act: Where Chapter VI of Regulation (EU) 2023/2854 applies to your use of the Services, you may request switching to another provider of data processing services covering the same service type, or porting to your own on-premises ICT infrastructure, by contacting support@bleanx.org. Bleanx's support team coordinates the transition, assistance, confirmation of completion, retrieval period, and subsequent erasure. The transfer may use the complete self-service export, programmatic retrieval of that package, or relevant separate Project exports. You do not need a separate switching function in the application or to complete multiple downloads before requesting assistance.
You may identify the destination provider or infrastructure and authorize relevant third parties to assist. Bleanx requests only the information reasonably necessary to verify your authority, identify the relevant Services and data, and arrange the transfer. Ordinary export does not depend on a switching request; support remains an alternative channel for obtaining your data.
Data and Format: The complete export described in Section 1 provides account data and the data of all Projects you own in JSON, in a structured, commonly used, machine-readable form, together with necessary files. For switching, Bleanx ensures that the transfer covers all exportable data and digital assets within the applicable statutory scope: relevant inputs and outputs, saved Section values and Project Output, Project structure and relationships, settings and configuration, associated metadata, and applicable AI-origin indicators. Digital assets that cannot adequately be represented in JSON are provided in a usable form. The safeguards for other persons' rights and protected internal information in Section 1 apply without narrowing mandatory access, retrieval, or portability rights. Export does not alter ownership of the materials or expand access to other users' private content.
Bleanx maintains a publicly accessible, up-to-date export-format documentation page on bleanx.com. It identifies the exportable categories and the categories excluded as protected internal data, the data structures and formats, the relevant standards or open interoperability specifications, and the available transfer methods and known technical limitations. The page is made available with these Terms before the contract is concluded and is supplied with the export. Exclusions for protected internal information do not extend beyond what applicable law permits and are not used to impede or delay switching. Export does not transfer ownership of Bleanx software, system instructions, or other protected components outside the statutory exportable scope.
Open Interfaces and Assistance: The complete export is available to you and a destination provider you authorize through the programmatic interface described in Section 1, using an export access key that you create and may revoke. Bleanx provides this interface free of charge and on an equal basis, together with public documentation sufficient to develop software that communicates with the Services for the applicable data portability and interoperability purposes. Access is protected by appropriate authentication, authorization, and safeguards for the rights and data of others; an open interface does not mean public access to user data.
The interface complements self-service downloads and support-led switching and is not limited to customers whose contracts have already ended. Bleanx complies with applicable requirements for in-parallel use under Article 34 and with mandatory interoperability specifications and standards when applicable to the relevant service type. Access arrangements during the post-transition retrieval period preserve the right to obtain the data without requiring restoration of full account functionality.
Bleanx provides reasonable assistance to you and third parties you authorize, supports your exit strategy for the contracted Services, and provides relevant information, including known risks to continuity. During the transition, the applicable service contract remains in effect; Bleanx acts with due care to maintain business continuity and continues the contracted functions and services. Bleanx maintains a high level of security during transfer and retrieval. The parties involved cooperate in good faith to make the transfer effective. These obligations do not constitute a promise that every destination service has identical features or that Bleanx will reproduce its proprietary software for another provider.
Notice and Transition Periods: Bleanx processes the switching request without undue delay. Any notice period required to initiate switching may not exceed two months from receipt of your request. Bleanx confirms the applicable start date and transition arrangements in writing. The transitional period begins after that notice period and does not exceed 30 calendar days, subject only to the exceptions described below. These are maximum periods, not mandatory waiting periods that override an earlier feasible or agreed completion.
Requests for access to or portability of personal data remain subject to the GDPR response periods in Section 6 of the Privacy Policy, as referenced in Section 1. If one request covers both those rights and switching, Bleanx applies the relevant period to each part; a longer transition does not postpone compliance with the GDPR request. The switching notice and transitional periods do not delay ordinary self-service export or apply automatically to a support request for a copy without switching.
If completing the transition within 30 calendar days is technically unfeasible, Bleanx notifies you within 14 working days of your switching request, gives a duly justified explanation, and specifies an alternative transitional period that does not exceed seven months. Service continuity is maintained throughout that alternative period. Separately, you have the right to extend the transitional period once for a period that you consider more appropriate for your purposes.
Completion, Retrieval and Erasure: Upon successful completion of the switching process, the contract for the Services covered by the switch is considered terminated, and Bleanx notifies you of that termination. Your exportable data and digital assets remain securely available for retrieval for at least 30 calendar days after the agreed transitional period ends, including any applicable extension. This retrieval does not require restoration of full account functionality and is not an account recovery period.
After that retrieval period, or a later period agreed with you, and provided that the switching process has been successfully completed, Bleanx fully erases the exportable data and digital assets generated directly by you, or relating directly to you, in accordance with the EU Data Act. Any records that must separately be retained under applicable law remain subject to the limited purposes, safeguards, and retention rules in the Privacy Policy. This does not authorize continued operational use of data that must be erased.
You may instead choose erasure of your exportable data and digital assets without switching. You may use the immediate account-deletion process above; the switching notice period does not impose a recovery window or postpone that confirmed immediate deletion. If erasure upon service termination is requested through the Data Act process rather than immediate account deletion, the relevant contract terminates no later than the end of the applicable notice period, and Bleanx notifies you. A request to switch is not treated as a request for immediate irreversible deletion, and neither route waives mandatory rights.
Mandatory prohibitions and limits on switching charges under Article 29 of the EU Data Act apply. This provision does not introduce or authorize a new switching or export fee, alter the agreed Subscription charges, or permit recurring charges after the relevant Subscription has ended. Refunds and other mandatory consumer rights remain governed by Sections 5 and 7, the Apple purchase procedures in Section 18 where relevant, and applicable law.
13. Indemnification
Third-Party Claims in Business Use: If you use the Services in the course of a business or professional activity and are not acting as a consumer under applicable law, you indemnify Bleanx against substantiated losses arising from third-party claims, but only to the extent directly caused by your intentional or negligent breach of these Terms, applicable law, or the rights of third parties.
This may include unlawfully providing or using materials, breaching confidentiality obligations, or using the Services or Output for deception or other unlawful activity. Merely using the Services, providing User Content, or generating, accepting, saving, or using Output does not create an indemnification obligation without the relevant breach and causal connection.
Bleanx's Own Responsibilities: You are not required to indemnify losses to the extent caused by Bleanx's acts or omissions, breach of its obligations, defects in the Services, or acts of persons engaged by Bleanx for whom it is responsible. Where a loss has more than one cause, indemnification is limited to the portion attributable to your breach.
Activity through your account does not, by itself, establish your responsibility for unauthorized acts of other persons; the rules in Section 3 apply. This Section does not create a warranty of authorship, originality, or non-infringement of Output merely because it is generated or saved, and does not alter the allocation of rights under Sections 1 and 4.
Amount and Procedure: Indemnification is limited to proven amounts under a final judgment or a settlement agreed to by you in writing, together with reasonable, necessary, and documented costs of defending the relevant claim. Bleanx takes reasonable steps to mitigate losses and does not obtain double recovery.
Bleanx gives you timely notice of the claim, its grounds, and the indemnification sought, and a reasonable opportunity to participate in the defense. Any failure to give timely notice is taken into account to the extent it prejudices your ability to defend the claim or increases the costs. Without your written consent, Bleanx may not enter into a settlement requiring you to pay, admit wrongdoing, or undertake other obligations.
The assertion of a claim does not, by itself, require you immediately to pay any expenses claimed or to assume Bleanx's defense. The grounds, causal connection, and amount of indemnification must be substantiated.
Consumers and Mandatory Rights: If you act as a consumer, the additional contractual indemnification obligation in this Section does not apply. This does not exempt you from liability for your own violations under applicable law. Nothing in this Section limits mandatory user rights or Bleanx's own liability.
14. Limitations of Liability
Bleanx's Responsibilities: Bleanx is responsible for breach of its obligations under these Terms and applicable law to the extent provided by them. The involvement of AI, use of external providers, or your obligation to verify Output does not, by itself, relieve Bleanx of responsibility for its own acts or omissions, defects in the Services, or acts of persons it engages for whom it is responsible.
Business Outcomes: Bleanx does not guarantee that use of the Services will secure investment, profits, or any other particular business outcome. Failure to achieve an expected outcome does not, by itself, establish a breach by Bleanx. This does not exclude a claim based on an established breach by Bleanx and loss caused by that breach.
Availability and Interruptions: Bleanx does not guarantee uninterrupted operation of the Services. To the extent permitted by applicable law, Bleanx is not liable for losses arising from interruptions or failures caused by third-party services, including hosting, AI, payment, search, or internet services, or other circumstances beyond its reasonable control, or from brief technical disruptions during updates that occur despite reasonable precautions. This exclusion applies only to the extent that the interruption, failure, or resulting loss is not attributable to Bleanx's own negligence or another breach for which it is responsible. It does not exclude liability for loss or corruption of data caused by Bleanx's fault, or responsibility for persons engaged by Bleanx where applicable law makes Bleanx responsible for them. The mere involvement of a third-party service does not establish an exemption.
This provision does not remove Bleanx's own obligations concerning reasonable care, security, or protection of data. Mandatory user rights, including applicable rights to have the Services brought into conformity, receive a price reduction or refund, or terminate a contract, remain unaffected, including where the law does not make such a remedy conditional on Bleanx's fault.
Liability That Is Not Limited: The exclusions and monetary limits in this Section do not apply to fraud, intentional misconduct, or gross negligence by Bleanx; liability for death or personal injury to the extent its limitation is prohibited; mandatory rights to compensation for breaches of personal data protection law; or any other liability that cannot lawfully be excluded or limited. They do not reduce refunds or other payments Bleanx is required to make under Sections 5, 6, 7, or 12 or applicable law, or remove mandatory consumer remedies. These protections prevail over inconsistent language in this Section or Section 15.
Categories of Loss: Subject to the preceding provisions and to the extent permitted by applicable law, Bleanx and its directors, employees, partners, agents, suppliers, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, use, goodwill, or other intangible losses, whether based on warranty, contract, tort (including negligence), or another legal theory, whether or not informed of the possibility of such damage and even if a stated remedy fails of its essential purpose. Loss or corruption of data is not excluded merely because it concerns data; its classification and recoverability remain subject to applicable law and the preceding protections.
Aggregate Liability Limit: Subject to "Liability That Is Not Limited" above and the safeguards below, this limit applies to all users only to the extent permitted by applicable law. Bleanx's total aggregate liability to you for all claims arising out of or relating to the Services or these Terms, taken together, shall not exceed the greater of (i) USD 100; or (ii) the total amount actually paid by you for the Services, including Subscriptions and separate purchases of Usage Credits, during the twelve (12) months immediately preceding the first event giving rise to any of your claims subject to this limit.
This is one overall aggregate limit for all of your claims subject to it, not a separate limit for each claim, event, related series of events, Project, or legal theory. The calculation uses the first such event and does not restart for subsequent claims or events. Amounts paid to satisfy liability subject to this limit count toward that single limit. Payments made by other users do not increase your limit merely because those users participate in the same Project.
The limit does not, by itself, entitle you to payment of its full amount. Liability and compensation depend on the losses established and the applicable legal requirements. Ordinary negligence by Bleanx, including loss or corruption of data caused by its fault, is not excluded merely by this limit, although the amount recoverable may be limited where applicable law permits.
Mandatory Rights and Application of the Limit: This limit does not apply to the matters identified in "Liability That Is Not Limited" and does not reduce refunds or other payments Bleanx is required to make under Sections 5, 6, 7, or 12 or applicable law. Those liabilities, refunds, and payments are not counted toward or deducted from the limit. In particular, no mandatory consumer right or remedy that cannot be excluded or limited by contract is restricted by this provision. Consumer status and the applicable protections are determined by applicable law, not merely by a user's occupation, plan, or role in a Project.
Where applicable law makes this limit inapplicable or unenforceable, including in relation to a consumer or a particular claim, Bleanx does not rely on it in that case. Other independently valid provisions of this Section and these Terms remain effective only insofar as they can lawfully operate without the inapplicable provision. This does not require an unfair term to be rewritten or reduced to preserve its enforceability, and does not override any mandatory rule requiring that term to be disapplied.
15. Disclaimer
Scope of Disclaimers: The disclaimers in this Section apply only to the extent permitted by applicable law and do not override Bleanx's express commitments under these Terms, its own duties of reasonable care, security, and data protection, or the protections in Section 14. They do not transfer responsibility for Bleanx's own negligence or loss of data caused by its fault to you, or limit mandatory user rights and remedies.
Except for those commitments and obligations, the Services are provided on an "as is" and "as available" basis without additional warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance, to the extent such warranties may lawfully be disclaimed.
Availability and Technical Limitations: Bleanx does not guarantee uninterrupted operation or availability at every time or location, or that every technical error, vulnerability, or harmful component can always be prevented. The limited rules concerning third-party interruptions, circumstances beyond reasonable control, and brief update-related disruptions are set out in Section 14 and remain subject to the exceptions and mandatory rights stated there. This is not a disclaimer of Bleanx's obligations to apply appropriate safeguards, remedy defects, or provide other remedies where required by these Terms or applicable law.
Output and Professional Advice: Bleanx does not guarantee that the results of using the Services will meet every particular requirement or that AI-generated Output will be accurate, complete, reliable, or suitable for every purpose. The rules on verification of information and Output in Sections 1 and 4 apply without relieving Bleanx of its own responsibilities under Section 14. The Services are not intended to provide, and do not constitute, legal, financial, investment, tax, accounting, or other professional advice. You should consult appropriate professional advisers before making material business decisions based on content created using the Services.
16. Exclusions and Mandatory Rights
The warranty disclaimers and limitations of liability in Sections 14 and 15, including exclusions of categories of loss and the aggregate monetary limit, apply only to the extent permitted by applicable law. They do not restrict mandatory rights, warranties, remedies, refunds, or other payments that cannot be excluded or reduced by contract.
If a particular exclusion or limitation cannot lawfully apply to you or your claim, Bleanx does not rely on it. Other independently valid provisions remain effective only to the extent that applicable law permits them to operate without the inapplicable provision. This Section does not require an unfair term to be preserved by rewriting or reducing it.
"Liability That Is Not Limited" in Section 14 continues to take precedence. Nothing in this Section expands any exclusion or limitation of Bleanx's liability under these Terms.
17. Confidential Information
"Confidential Information" means non-public information that one party (the "Discloser") discloses or makes available to the other party (the "Recipient") in connection with these Terms and that is identified as confidential or should reasonably be understood to be confidential in light of its nature and the circumstances.
On the user's side, Confidential Information may include non-public business information and Project materials, as well as private personal content provided or processed through the Services. Non-public Output containing or reflecting such information is protected to the corresponding extent. A separate confidentiality marking is not required on every item where its confidential nature is apparent from the circumstances.
On Bleanx's side, Confidential Information may include non-public technical and commercial information about the Services that meets those criteria. Published prices, public feature descriptions, export-format documentation, and public descriptions of the programmatic interface do not become confidential merely because they relate to Bleanx. This does not apply to non-public access keys or other secret authentication credentials.
Confidential Information does not include information that the Recipient can demonstrate: (a) was lawfully known to it without a confidentiality obligation before disclosure; (b) was independently developed without use of Confidential Information; (c) was lawfully received from a third party without breach of a confidentiality obligation; or (d) became publicly available without the Recipient breaching the relevant obligations.
These exceptions do not remove applicable personal data protection obligations or other restrictions imposed by law.
Treating information as confidential does not alter the allocation of rights under Sections 1 and 4 or grant additional rights of access, use, or disclosure. Making materials available to authorized Team participants or Reviewers within the scope of Section 1 does not, by itself, make them publicly available. Permitted export and transfer to an authorized destination provider are governed by Sections 1 and 12.
Protection and Permitted Disclosure: Each party receiving the other party's Confidential Information takes reasonable measures to protect it against unauthorized access, use, and disclosure. Use is permitted only for purposes and actions authorized by these Terms and applicable law.
The Recipient may disclose the necessary portion of Confidential Information to its employees, officers, directors, contractors, service providers, and professional advisers only where they need that information to perform the relevant authorized task. Before receiving access, those persons must be subject to applicable contractual, statutory, or legally binding professional confidentiality obligations that provide appropriate protection for the information.
This permission operates subject to, and not in place of, the restrictions in Sections 1 and 4, the applicable provisions of Section 12, and the Privacy Policy. It does not expand access rights to Projects, personal Ask content, AI Dialogue, or direct correspondence, or replace required permissions for external AI processing or search.
Bleanx may disclose necessary data to its providers for the authorized provision, support, protection, and administration of the Services only within the permitted scope and in compliance with applicable contractual and legal requirements. This Section grants no additional permission for model training, product development, or other independent use of user data. The search provider's specific use of transmitted search queries is governed by the corresponding exception in Section 4. That exception does not extend to other Project materials or personal histories and does not override mandatory personal data protection requirements.
Required Disclosure and Legally Protected Reports: The Recipient may disclose Confidential Information to the extent required by applicable law or a legally binding requirement of a court or competent authority. Before disclosure, the authority of the requesting person or body and the applicable legal basis are verified, and the disclosed information is limited to what is necessary.
To the extent permitted by law and possible without missing a mandatory compliance deadline, the Recipient gives the Discloser prior written notice and a reasonable opportunity to seek protection or contest the disclosure. The Recipient takes reasonable measures to limit disclosure and preserve confidential treatment of the information provided. Specific mandatory notification rules remain applicable.
For personal data, the requirements for lawful processing and international transfers must also be met. Receipt of a request from a foreign authority does not, by itself, displace those requirements. Nothing in this Section prevents reports to competent authorities, the exercise of rights to legal protection, or reporting violations to the extent that the relevant disclosure is protected by applicable law. Such protected disclosure does not require the other party's prior consent.
Responsibility for Representatives: Each party is responsible for compliance with this Section by its employees and representatives to whom it provides Confidential Information to perform tasks on its behalf, as for its own acts or omissions.
Engaging a contractor or service provider does not relieve Bleanx of its own obligations or its responsibility for that person where these Terms or applicable law provide for that responsibility. A separate agreement with that person does not, by itself, transfer that responsibility to the user. A Team participant or Reviewer does not become a representative of Bleanx or the Project Owner merely because of their role or an invitation. Responsibility for that person's conduct is determined by the actual relationship, these Terms, and applicable law.
These provisions do not change Bleanx's agreed limitations of liability or the exceptions to them in Sections 14 and 16, or create an additional obligation for the user to indemnify Bleanx beyond Section 13 and applicable law.
Duration of Confidentiality; No Retention Period: The confidentiality obligations in this Section apply for seven years from disclosure of the relevant information, subject to the exceptions in the definition of Confidential Information. Termination of these Terms, account closure, or loss of access to a Project does not, by itself, end those obligations before the relevant period expires. Information constituting a trade secret under applicable law remains protected for as long as it enjoys that legal protection.
The seven-year period is a period of contractual confidentiality protection, not a data retention period. It neither requires nor authorizes Bleanx to retain an account, Project, personal AI history, correspondence, export package, or backup copy for seven years. Deletion, return, and permissible retention of data are governed separately by Sections 1 and 12, the Privacy Policy, and applicable law. Required deletion is not deferred until the confidentiality period ends.
Expiry of this period grants no additional rights to use or disclose materials, does not remove continuing processing restrictions under Sections 1 and 4, and does not end applicable personal data protection obligations. Information lawfully retained remains protected in accordance with applicable law and the other continuing provisions of these Terms.
18. Apple App Store Applications and Purchases
Scope and Agreement: This Section applies to Bleanx applications obtained through the Mac App Store or App Store (each, an "App"), on the compatible Apple platforms supported by the relevant App. It applies only to an App actually made available and does not promise a release for any platform or availability in every country. These Terms, including this Section, are an agreement between you and Bleanx, not Apple. Bleanx, not Apple, is responsible for the App and its content. The account requirements, content ownership, access permissions, AI rules, and data protection provisions elsewhere in these Terms continue to apply.
App License: Bleanx grants you a non-transferable license to use the App on compatible Apple-branded products you own or control, as permitted by the Usage Rules in the applicable Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing as provided by those Usage Rules. This license does not permit shared Bleanx sign-in credentials or grant ownership of, or access to, another user's Projects. Subscription entitlements and Project access remain governed by the applicable purchase and access rules. App usage rules under these Terms do not override the applicable Apple Usage Rules.
Compatibility and Notifications: Compatibility requirements are stated for the relevant App release. Cloud features require connection to the Services; this Section does not promise offline operation or identical functionality in every version. App notifications follow operating-system permissions and settings. You may disable them without losing access to the App's core functionality. Push notifications do not include confidential Project content or private correspondence. Necessary service communications remain governed by Section 8. This Section does not provide for SMS or MMS messaging.
Maintenance, Support, and Warranties: Bleanx is responsible for maintenance and support specified in these Terms or required by law; Apple has no obligation to provide them. Bleanx is responsible for express warranties and warranties imposed by law to the extent they have not lawfully been disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation; other claims, losses, liabilities, damages, costs, and expenses attributable to the warranty failure are Bleanx's responsibility. This App-price remedy is distinct from a refund of a Subscription or Usage Credit purchase.
Product and Intellectual Property Claims: Bleanx, not Apple, is responsible for addressing your or a third party's claims relating to the App or its possession or use, including product-liability claims, failure to meet legal or regulatory requirements, and claims under consumer-protection, privacy, or similar laws. Bleanx, not Apple, is responsible for investigating, defending, settling, and discharging a third-party claim that the App or your possession and use of it infringes that party's intellectual property rights. Sections 14–16 apply only within lawful limits and do not remove mandatory developer obligations.
Legal Compliance and Third-Party Terms: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not on a U.S. Government list of prohibited or restricted parties. The applicable sanctions and export-control rules in Section 2 remain in effect. You must comply with applicable third-party terms when using the App, without displacing Bleanx's own obligations or the safeguards in Sections 1 and 4.
Developer Contact: The developer is Bleanx Inc., 2810 N Church St STE 88757, Wilmington, DE 19802, United States. App questions, complaints, or claims may be directed to support@bleanx.org. Telephone: (302) 407-0567.
Apple as Third-Party Beneficiary: You and Bleanx acknowledge that Apple and its subsidiaries are third-party beneficiaries of this license agreement as it relates to the App. Upon your acceptance, Apple has, and is deemed to have accepted, the right to enforce the agreement against you in that capacity.
Apple In-App Purchases
Available Purchases and Confirmation: In an available App, Founder and Executive monthly Subscriptions and separate Usage Credit top-ups are purchased through Apple In-App Purchase. Before confirmation, the offer identifies the features, the separate AI and web-search allowances and comparisons in Section 5, the price, currency, period, and renewal terms. The applicable Terms and Privacy Policy are accessible before purchase. Apple processes payment through the purchaser's Apple Account. Bleanx provides the corresponding entitlements after verifying the confirmed transaction; a pending or unfinished purchase does not itself confirm payment.
Purchase Channel and Account: Purchase-management rules follow the channel of purchase, not the device used to access Bleanx. Using a web Subscription in an App, or an Apple Subscription through the web service, does not change its billing channel. Allowance use and purchased balances relate to the relevant Bleanx account across devices and Projects. The one-paid-Subscription rule in Section 5 applies across web and Apple: a new Subscription in either channel is unavailable while an existing paid Subscription remains active. Switching purchase channel requires the existing Subscription to end before a new one is purchased; turning off auto-renewal alone does not end it early. This does not prevent Apple-managed plan changes within the same Subscription group described below. Bleanx identifies the applicable billing channel and provides access to its management route; these Terms do not promise automatic migration between Stripe and Apple. The common Explorer participation and new-invitation rules in Section 5 apply equally when an Apple Subscription ends.
Prices, Taxes, and Availability: App Store prices may differ from web prices. The applicable amount, currency, and tax information are shown before purchase. Apple calculates, collects, and remits taxes where required of it by applicable law and its agreement with Bleanx; Bleanx's own obligations remain and are not transferred to the user. The geographic availability rules for direct purchases in Section 5 apply only to direct web purchases. Apple purchases are available in the territories selected for the relevant App and purchase product, subject to Apple's availability requirements, applicable law, and sanctions. Availability of the App alone does not establish availability of every purchase product.
Renewal and Cancellation: An Apple Subscription renews automatically until cancelled through Apple's Subscription-management tools. Apple handles scheduled billing, payment retries, and the effective dates shown for that Subscription. Bleanx provides a route to manage or cancel it through Apple. Ordinary cancellation stops future renewals, with access continuing until the applicable end date shown by Apple, subject to mandatory rights. The web Cancel/Resubscribe controls, renewal-recovery window and payment retries, and web-specific post-termination refund rules do not govern Apple Subscriptions.
Apple Billing Grace Period: Bleanx enables a three-day Billing Grace Period for its monthly Apple Subscriptions. If Apple places a Subscription in that grace period following an unsuccessful renewal payment, Bleanx continues the paid-plan service, including the applicable AI and web-search access subject to the resource rules in Sections 4 and 5. The applicable start and end dates follow the Subscription status reported by Apple.
If payment is recovered within that grace period, the confirmed paid period follows the applicable Apple dates; consumption already accounted for is not charged twice. If payment is not recovered before grace ends, paid-plan access ends according to Apple's Subscription status. Consumption covered by an included allowance during grace is not converted retrospectively into a debt or a deduction from separately purchased Usage Credits. Valid use of purchased credits after exhaustion of the corresponding allowance remains governed by Sections 4 and 5. Billing retry after grace does not, by itself, extend paid access; any later confirmed recovery follows Apple's period and status rules rather than the late-payment rule for direct web Subscriptions.
Included Allowances and Purchased Credits: Apple Subscriptions include the two Monthly Usage Allowances described in Section 5 for each monthly Subscription period, not a purchased-credit balance. Included allowances have no separate monetary value and are not convertible into money or Usage Credits. Usage Credits bought separately through Apple do not expire; ending, cancelling, or changing a Subscription does not itself forfeit them. Their use after exhaustion of the corresponding allowance follows the same resource rules as direct web purchases. Refunds and account deletion are addressed separately and do not turn the absence of expiry into an unconditional right to exchange credits for money.
Changes Between Apple Plans: Founder and Executive are different levels in the same Apple Subscription group. A confirmed upgrade to Executive takes effect immediately and starts the corresponding new monthly Subscription period. Apple performs the applicable proportionate refund for the previous Subscription. A downgrade takes effect at the next renewal as determined by Apple, with the current paid plan continuing until then subject to the applicable resource rules. Each monthly Subscription period includes the AI and web-search Monthly Usage Allowances of the applicable plan. Separately purchased Usage Credits are not forfeited on either change.
Restoring Purchases: Bleanx provides a way to restore purchases that are restorable under Apple's rules and associates the verified entitlement with the appropriate Bleanx account. Restoring an existing purchase, signing in, or receiving a duplicate transaction notification does not create another Subscription period or grant a second copy of credits already purchased or consumed. A restored entitlement remains subject to its actual period and status.
Price and Allowance Changes: Changes to the price of an existing Apple Subscription follow Apple's notification and acceptance process, including express consent where required by Apple or applicable law. The separate web price-acceptance button does not replace that process. Adverse changes to either allowance or its consumption rules remain subject to the advance notice, separate express acceptance, and paid-period protection in Section 6. Acceptance of an Apple price change does not itself authorize an unaccepted reduction of the service entitlement.
Refunds and Mandatory Rights: Requests to refund an Apple purchase are submitted through Apple's applicable refund process. Bleanx support at support@bleanx.org assists with identifying purchases, entitlement problems, and Bleanx's own obligations, but the ordinary manual web-refund process does not replace Apple's process. These procedural distinctions do not remove a statutory right of withdrawal, a remedy for non-supply or lack of conformity, a valid legal notice, or Bleanx's own mandatory duties under Sections 7 and 12 or applicable law. A usage percentage does not automatically determine the refund or establish full performance of the monthly service. Any adjustment following a confirmed refund concerns the relevant purchase or entitlement, not unrelated purchased balances, and does not retrospectively turn completed use into a user debt.
Account Deletion: Uninstalling an App or deleting a Bleanx account does not itself cancel an Apple Subscription. Before account deletion, Bleanx explains the risk of continuing Apple charges and provides routes to manage or cancel that Subscription and request a refund through Apple. An active Subscription does not prevent immediate account deletion under Section 12. When Sign in with Apple is used, Bleanx revokes the relevant sign-in tokens as required for account deletion. Later billing events do not, by themselves, restore the deleted Bleanx account.
19. Governing Law
These Terms and the contractual relationship between you and Bleanx are governed by the laws of the State of Delaware, United States, subject to applicable U.S. federal law. Delaware conflict-of-law rules that would refer the matter to the law of another jurisdiction do not apply, except where mandatory rules require otherwise, including the protections described below.
Mandatory Consumer Protection: If you act as a consumer, the choice of Delaware law does not deprive you of the protection of mandatory provisions that would apply to the contract in the absence of that choice. In particular, where Article 6 of the Rome I Regulation applies, you retain the protection of provisions of the law of your country of habitual residence that cannot be derogated from by agreement. This includes cases where Bleanx pursues or directs the relevant activities to that country and the contract falls within the scope of those activities. Other mandatory safeguards under the applicable choice-of-law rules remain unaffected.
Other Mandatory Rules: This choice of law does not exclude rules that apply irrespective of the chosen contractual law, including applicable personal data protection requirements. It does not restrict the powers of competent authorities or user rights that cannot be waived by contract.
Applicable Law and Dispute Resolution: Court proceedings and arbitration are addressed separately in Section 20 and applicable law. Where a valid and applicable arbitration agreement exists, the JAMS Rules govern the relevant procedure but do not replace the law governing the merits of the dispute. This Section 19 does not itself confer exclusive jurisdiction on Delaware courts or create an additional obligation to arbitrate.
20. Arbitration and Class Action Waiver
Scope of the U.S. Arbitration Agreement: The mandatory arbitration agreement and associated class-action waiver in this Section apply only if your habitual residence is in the United States when you first accept this arbitration agreement, and only to the extent permitted by applicable law. They concern disputes, controversies, or claims between you and Bleanx arising out of or relating to the Services or these Terms ("Claims"). They do not govern disputes between Project participants merely because they use Bleanx. Nationality, interface language, temporary presence in the United States, or a purchase through a U.S. Apple storefront does not, by itself, determine habitual residence or the applicability of this agreement.
Users Outside the U.S. Scope: For users outside that scope, these Terms impose no mandatory pre-dispute arbitration or general contractual waiver of class or collective proceedings. Claims may be brought before a court of competent jurisdiction, subject to applicable law and mandatory consumer protections. Arbitration is available only if you and Bleanx separately agree to it after the dispute arises and that agreement is lawful.
Individual Arbitration: Unless you validly opt out below or an exception applies, you and Bleanx mutually agree to resolve Claims within the U.S. scope through final and binding individual arbitration administered by JAMS before one neutral arbitrator under its Comprehensive Arbitration Rules and Procedures (the "JAMS Rules"), subject to the applicable JAMS Consumer Minimum Standards and mandatory law. The JAMS Rules in effect when arbitration is commenced apply, subject to those safeguards. The JAMS Rules and Consumer Minimum Standards are available from JAMS and may also be requested from Bleanx. The law governing the merits is determined under Section 19. The Federal Arbitration Act governs this arbitration agreement to the extent applicable.
The arbitration is conducted in English, subject to any mandatory requirements and necessary arrangements under the applicable JAMS standards. The location and method of proceedings must not prevent a consumer from obtaining effective access to arbitration. These Terms do not require you to appear personally in Delaware. Hearing arrangements, including any remote participation, are determined under the applicable rules and mandatory protections. You have a reasonable opportunity to participate in selecting the neutral arbitrator, exchange relevant non-privileged information, and obtain a reasoned written award as required by those rules and standards. Judgment on an award may be entered in a court having jurisdiction.
Court and Other Exceptions: Either party may bring an eligible Claim in a small claims court within its jurisdiction or seek urgent injunctive, interim, or conservatory relief from a competent court. Nothing in this Section prevents reports or complaints to government or regulatory authorities, restricts their powers, or removes a claim, remedy, or right that cannot lawfully be subjected to mandatory arbitration or waived. A mandatory remedy that is unavailable in arbitration remains available before a competent court or through the other procedure required by law.
Class-Action Waiver Within the U.S. Agreement: Only within a valid and applicable U.S. arbitration agreement, and to the extent permitted by law, you and Bleanx agree to pursue covered Claims individually rather than through class or collective proceedings. For Claims required to be arbitrated, this means giving up a court or jury trial on the merits, subject to the exceptions above and applicable law. The waiver does not remove non-waivable representative claims, public injunctive relief, or other mandatory remedies. It is not an independent general restriction on collective proceedings for users outside the U.S. scope, users who validly opt out, or claims to which it cannot lawfully apply.
Thirty-Day Opt-Out: You may opt out of this arbitration agreement by sending an unequivocal written notice to support@bleanx.org or to Bleanx's postal address in Section 26 within 30 calendar days after you first accept it. Provide enough information to identify you and the relevant account. No explanation of your reasons, special form, account deletion, or Subscription termination is required. Sending the notice within that period is sufficient; it is not subject to Bleanx approving your decision. Bleanx records the notice and confirms its receipt through an available contact channel.
A valid opt-out is mutual: neither you nor Bleanx may require arbitration under this agreement. The associated class-action waiver also ceases to apply to you. Opting out does not affect your access to the Services or the remaining Terms. Bleanx retains the opt-out status in accordance with the Privacy Policy and applicable law; a general update to the Terms does not, by itself, cancel a valid opt-out or substitute a new arbitration acceptance.
Arbitration Costs: Consumer proceedings are subject to the applicable JAMS Consumer Minimum Standards and any more protective mandatory requirements. Where those standards apply and you initiate arbitration as a consumer, your required arbitration fee is limited to the consumer filing fee permitted by those standards, subject to any applicable waiver or more protective rule. Bleanx pays all remaining JAMS filing and administration fees and the arbitrator's fees. If Bleanx initiates arbitration against a consumer, Bleanx pays the arbitration fees and costs required of it under those standards. Commercial proceedings follow the applicable JAMS fee rules, subject to mandatory law.
The allocation and payment of arbitration fees are separate from the damages limit in Section 14. Bleanx may not use that limit to reduce its required payment of procedural costs or count those payments against the user's available damages limit. This Section creates no general rule requiring an unsuccessful user to pay all of Bleanx's legal expenses. Applicable statutory rights concerning legal costs and the protections of the JAMS Consumer Minimum Standards remain unaffected.
Mandatory Rights and Availability of the Procedure: Sections 16 and 19 and other mandatory safeguards remain applicable. An invalid or inapplicable restriction does not bar access to a competent court or another legally required procedure. If the agreed arbitration cannot proceed because Bleanx fails to comply with the requirements necessary for JAMS to administer it, Bleanx does not rely on this agreement to prevent you from bringing the Claim before a competent court. This Section does not confer exclusive jurisdiction on Delaware courts.
21. California Residents
If you are a California resident, you may direct questions and complaints concerning the Services to Bleanx using the contact details in Section 26. Payment, Subscription cancellation, and refund terms are set out in Sections 5–7 and, for Apple purchases, Section 18, subject to mandatory user rights.
For consumer protection information and assistance with directing a complaint, you may also contact the California Department of Consumer Affairs, Consumer Information Center, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. The handling of an inquiry depends on the relevant authority's jurisdiction; this provision does not promise that it will resolve every dispute or provide a refund.
Where California Civil Code Section 1789.3 applies to the relevant contract, Bleanx provides the required information about the service provider, charges, and complaint procedures when the contract is concluded and annually, no later than June 30 of each year thereafter.
Users in other jurisdictions may also contact the competent consumer protection authorities in their country or state.
This Section does not limit mandatory user rights or require you first to contact Bleanx support or the Department of Consumer Affairs before using available legal remedies. The ability to contact government authorities is preserved regardless of whether the arbitration agreement in Section 20 applies.
22. Changes
Grounds and Limits: Bleanx may update these Terms to reflect changes in mandatory requirements, correct errors or ambiguities, maintain security and technical compatibility, or reflect lawfully introduced changes to the Services. An update must be proportionate to its stated reason and follow this Section; this is not an unrestricted right to change the contract unilaterally. The same safeguards apply to Supplementary Terms forming part of your contract.
Notice and Retainable Versions: Bleanx publishes each revised version with its effective date. For material changes affecting existing users, Bleanx sends notice by email at least 30 calendar days before the announced effective date, provides access to the revised version through the Services, and enables you to retain an unchanged copy. The notice explains the material changes, their reasons, when they would apply, whether acceptance is required, and the consequences of non-acceptance. Where non-acceptance would end a Subscription, it specifies your individual Subscription end date and serves as advance notice of that conditional termination. It also explains the restricted Explorer access described below. Longer mandatory notice periods, additional notices, and other applicable requirements remain binding.
Express Acceptance: A revision that materially increases your obligations or reduces your rights applies to you only after your separate express acceptance, except to the extent the change is directly required by law. Bleanx provides a clearly labelled control for accepting the identified revised version and records the version and the date and time of your acceptance. Silence, failure to object, signing in, or merely continuing to use the Services is not such acceptance. Corrections of typographical errors and editorial clarifications that do not change legal meaning do not require renewed acceptance. Accepting revised Terms does not, by itself, authorize a new payment, reverse a cancellation you have requested, or reinstate a Subscription that has ended.
Paid Subscribers Who Do Not Accept: If you have a paid Subscription and have not accepted a material revision requiring acceptance by its announced effective date, your Subscription continues on its previously agreed terms until the end of the paid monthly period current on that date. It then ends, future recurring Subscription charges cease, and your account moves to Explorer. The individual end date and these consequences are disclosed in the advance notice. Until that lawful end date, non-acceptance alone does not remove the paid access to which you remain entitled. Your existing rights to cancel earlier and seek a refund remain available. A cancellation or other lawful ending already applicable under Sections 5 or 18 is not reversed by this process.
Explorer Users Who Do Not Accept: From the notified effective date, an Explorer user who has not accepted a material revision requiring acceptance may use the account only to obtain and export their data or delete the account, rather than for ordinary use of the Services, subject to the mandatory rights and necessary administrative access below. The same restriction applies after a non-accepting paid subscriber moves to Explorer at the lawful end of the Subscription. Ordinary Explorer use resumes after express acceptance of the revised version, subject to the applicable access and feature rules. Authentication needed to exercise these rights, access to the Terms and acceptance control, legally required account or payment-management routes, refund requests, complaints, and the exercise of statutory rights remain available without requiring acceptance. Buying Usage Credits separately does not, by itself, make an Explorer account a paid Subscription.
Preserved Rights and Lawful Timing: Non-acceptance is not a breach of these Terms. It does not, by itself, delete your account or Projects, change ownership of their content, or forfeit separately purchased Usage Credits. Applicable refund rights under Section 7, Apple purchase rights under Section 18, and rights of access to data, export, retrieval, and portability under Sections 1 and 12 remain available. Preservation of an account or data does not create a new or indefinite retention period. Neither acceptance nor this non-acceptance process validates an otherwise unlawful change or removes rights acquired under an earlier purchase.
If mandatory law requires longer notice or other conditions before ending a Subscription or restricting access, Bleanx complies with them first; the previously agreed terms remain in effect until the lawful end date, and Bleanx informs you of any necessary adjustment to the notified date. These provisions do not authorize retroactive charges or a reduction of an already paid period. For Apple Subscriptions, Bleanx implements the ending of the Subscription in coordination with the applicable Apple procedures and requirements in Section 18. Neither non-acceptance nor a restriction in the Bleanx account itself cancels Apple billing. Bleanx must coordinate the cessation of service and recurring billing, and any required refunds, rather than leave recurring charges in place for service that it has stopped providing under this Section. Applicable Apple requirements and mandatory protections are met before the restriction or termination is applied.
Urgent Changes: A shorter notice period is permitted only to the extent necessary to comply with law or take an objectively necessary immediate measure against a substantial security threat, and only where applicable law permits. Bleanx informs you as far in advance as reasonably possible, or without undue delay after the measure if advance notice is impossible or prohibited. This exception does not authorize unrelated changes to prices, contractual rights, or data processing, and does not dispense with consent where it is legally required.
Changes to a Continuing Digital Service: Where Article 19 of Directive (EU) 2019/770 and its applicable implementing law govern a consumer contract, a modification beyond what is necessary to maintain conformity must have a valid contractual reason, such as necessary adaptation to a changed technical environment or the withdrawal of support for third-party technology used by the Services. The modification is made without additional cost to the consumer and is explained clearly and comprehensibly. If it negatively affects access to or use of the service more than only to a minor extent, Bleanx provides reasonable advance information on a durable medium about its features and timing and the right to terminate or retain the unmodified service. The consumer may terminate free of charge within 30 days of receiving that information or of the modification, whichever is later. The mandatory consequences of termination, including refunds and retrieval of data, apply. That termination right does not arise under Article 19 where Bleanx actually enables the consumer to retain the unmodified service without additional cost and it remains in conformity. This is not a promise to maintain every former product version; the separate acceptance and paid-period safeguards elsewhere in these Terms remain applicable.
Special Safeguards: This Section does not override the specific price, allowance, and consumption-rule protections in Section 6, the Apple purchase procedures in Section 18, or the scope, exceptions, and valid opt-outs in Section 20. A general acceptance of revised Terms does not replace a separate acceptance required for a particular change, cancel an arbitration opt-out, or authorize data processing that requires a separate permission. Revisions do not operate retrospectively to reduce accrued rights or existing claims. Updating these Terms does not itself grant additional licenses in User Content or Output or replace required permissions for external AI processing, search, or personal data processing. Mandatory rights under applicable law remain unaffected.
23. Waiver and Severability
A failure or delay by either party in exercising a right does not, by itself, waive that right. A waiver in one instance does not, by itself, waive the right in other instances. This provision does not extend statutory time limits or displace mandatory consequences under applicable law.
If a provision of these Terms is invalid, unenforceable, or cannot lawfully apply to a particular user or claim, it is not applied to that extent. Other independently valid provisions remain effective only insofar as the contract can lawfully continue without that provision.
This rule does not require an unfair term to be rewritten to preserve its enforceability or restrict mandatory user rights. The specific safeguards in Sections 14, 16, 19, and 20 remain applicable.
24. Entire Agreement
These Terms, together with additional terms expressly incorporated into the contract and validly agreed with you for the relevant purchase or use of the Services, constitute the agreement between you and Bleanx on those matters.
A previous version of these Terms is replaced only in accordance with Section 22. This Section does not extinguish accrued rights or claims, the terms of purchases already made, a valid arbitration opt-out, or transfers or grants of rights in materials already made.
Pre-purchase information that forms part of the contract under applicable law retains that effect. This Section does not exclude the mandatory legal effects of Bleanx's public statements about the Services, relieve Bleanx of liability for fraud or misleading statements, or make an unaccepted change to a pricing page a change to your contract.
The Privacy Policy governs the processing of personal data within its stated scope and applicable law. Referring to it or accepting these Terms does not, by itself, replace separate consent to processing where required.
References to external providers' rules have only the scope expressly stated in the relevant provisions of these Terms. They do not automatically incorporate all commercial agreements between Bleanx and those providers into your contract.
25. Survival
After termination of a contract, Subscription, or access, provisions that are intended by their purpose or express terms to continue remain effective only within their stated scope and for the applicable period.
These include the allocation of rights in materials and continuing permissions under Sections 1 and 4; confidentiality obligations for the period specified in Section 17; necessary settlements, refunds, and data-related obligations under Sections 7 and 12; applicable indemnification, liability, disclaimer, and mandatory-rights provisions under Sections 13–16; and governing law and a valid dispute-resolution arrangement under Sections 19 and 20, including arbitration opt-outs and other exceptions.
Termination does not, by itself, reverse a transfer or grant of rights in Project materials or transfer those materials to Bleanx. Survival of particular provisions does not extend a paid Subscription or ordinary access to the Services, expand Bleanx's permissions to use materials, or create a new data retention period.
Mandatory user rights, required deletion, and applicable data-retrieval periods remain governed by the relevant provisions of these Terms and applicable law.
26. Contact Us
For questions, notices, complaints, and claims concerning the Services or these Terms, you may contact Bleanx using the details below.
These contact methods supplement, rather than replace, the available features and other ways of contacting Bleanx provided by these Terms or applicable law. Providing a telephone number does not mean that a call is required to cancel a Subscription, delete an account, or exercise other rights.
